AN ORDINANCE PROVIDING FOR THE AMENDMENT
OF THE COMPREHENSIVE PLAN OF THE
CITY OF McHENRY, McHENRY COUNTY, ILLINOIS
WHEREAS, Petitioner, McHENRY STATE BANK, as Trustee under the
provisions of a Trust Agreement dated August 1, 1988 and known as Trust No.
4438, record title owner, filed a Petition with the Plan Commission of the
City of McHenry, Illinois, requesting an amendment to the Comprehensive Plan
of the City of McHenry in regard to the following described property:
Part of the Northeast Quarter and part of the Southeast Quarter of
Section 4, Township 44 North, Range 8 East of the Third Principal
Meridian, described as follows: Commencing at the Southeast
corner of said Northeast Quarter, and running thence North along
the Section line, 5 chains and 5 links; thence West parallel with
the East and West Quarter Section line, a distance of 1184.99 feet
to the center line as traveled of Crystal Lake Road, for a point
of beginning; thence North 88 degrees, 29 minutes 57 seconds East
(bearing assumed) along the last described parallel line, a
distance of 272.37 feet; thence South 00 degrees, 18 minutes, 45
seconds East, a distance of 653.24 feet to the center line of Bull
Valley Road, as dedicated by Dedication recorded November 30, 1972
as Document No. 607443; thence Northwesterly along said center
line, being a curve to the right and having a radius of 1432.40
feet, an arc distance of 399.55 feet to the West line of the
Northeast Quarter of said Southeast Quarter of Section 4; thence
North 00 degrees, 18 minutes, 42 seconds West along said West
line, a distance of 122.38 feet to the Northerly right of way line
of said Bull Valley Road; thence North 63 degrees, 21 minutes, 58
seconds West along the Northerly right of way line of said Bull
Valley Road, a distance of 173.29 feet to the intersection with
the center line as traveled of said Crystal Lake Road; thence
Northeasterly along said center line, being a curve to the left
and having a radius of 14323.60 feet, an arc distance of 480.96
feet to the point of beginning, in McHenry County, Illinois.
AND, WHEREAS, a hearing was held before the Plan Commission of the
City of McHenry, Illinois, in regard to the contents of the Petition, and
evidence was introduced by the Petitioner at such hearing in support of its
position;
AND, WHEREAS, as a result of said hearing, and after consideration
of the contents of the Petition and evidence presented in support of the
Petition, the Plan Commission of the City of McHenry, Illinois, did recommend
to the City Council of the City of McHenry that the provisions of the
Comprehensive Plan of the City of McHenry be amended to change the
classification of the premises from Urban Residential to
Commercial.
AND, WHEREAS, the City Council of the City of McHenry, Illinois,
has fully considered the recommendation as submitted by the Plan Commission of
the City of McHenry;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
McHENRY, McHENRY COUNTY, ILLINOIS, as follows:
SECTION 1: That the Comprehensive Plan of the City of McHenry,
McHenry County, Illinois, and such Plan as amended, be and is hereby amended
so that a portion of the above described premises which is presently
classified Urban Residential under the terms of the Comprehensive Plan
of the City of McHenry be and it is hereby changed to Commercial under the
terms of said Comprehensive Plan, and said Plan as amended, which portion is
described as follows:
Part of the Northeast Quarter and part of the Southeast Quarter of
Section 4, Township 44 North, Range 8 East of the Third Principal
Meridian, described as follows: Commencing at the Southeast

SECTION 2: This Ordinance shall be in full force and effect from
and after its passage as provided by law.
