AN ORDINANCE PROVIDING FOR THE ANNEXATION
OF CERTAIN DESCRIBED REAL ESTATE TO
THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS
WHEREAS, the McHENRY STATE BANK, as Trustee under the provisions
of a Trust Agreement dated August 1, 1988 and known as Trust No. 4438, is the
record owner of the real estate hereinafter described; and
WHEREAS, no electors reside on the real estate hereinafter
described; and
WHEREAS, said real estate is contiguous to the existing corporate
limits of the City of McHenry, Illinois, and is not located within the
corporate boundaries of any other City or Village and has no electors residing
therein; and the aforesaid record owner desires annexation of said real
estate and has petitioned the corporate authorities of the City of McHenry,
Illinois, in writing and under oath, for annexation of said real estate; and
WHEREAS, the City of McHenry does not provide fire protection or a
public library and therefore no notice is required to the districts providing
those services to the land.
WHEREAS, the land proposed to be annexed does not include any
roads or road right-of-ways under the jurisdiction of any township and
therefore no notice is required to be given to any township.
WHEREAS, the Corporate Authorities for and on behalf of the City
of McHenry, McHenry County, Illinois, have heretofore approved an Annexation
Agreement bearing the date of October 3, 199Q between itself and the McHENRY
STATE BANK, as Trustee under the provisions of a Trust Agreement and known as
Trust No. 4438, record title owner to said real estate hereinafter described,
which provides in part for the annexation of said raal estate to the existing
corporate limits of the City of McHenry, McHenry County, Illinois, for the

classification of said real estate under the provisions of the City of McHenry
Zoning Ordinance, and for amendment of the Comprehensive Plan of the City of
McHenry; and
WHEREAS, upon proper notice, public hearings were held pursuant to
the State Statute and the appropriate provisions of the Zoning Ordinance of
the City of McHenry relative to the request for annexation, zoning, and
amendment of the Comprehensive Plan of the City of McHenry.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
McHENRY, McHENRY COUNTY, ILLINOIS, as follows:
SECTION 1: The following described real estate be and the same is
hereby annexed to and made a part of the corporate limits of the City of
McHenry, Illinois, including any and all portions of adjacent streets, roads,
or highways as required by Law:
Part of the Northeast Quarter and part of the Southeast Quarter of
Section 4, Township 44 North, Range 8 East of the Third Principal
Meridian, described as follows: Commencing at the Southeast
corner of said Northeast Quarter, and running thence North along
the Section line, 5 chains and 5 links; thence West parallel with
the East and West Quarter Section line, a distance of 1184.99 feet
to the center line as traveled of Crystal Lake Road, for a point
of beginning; thence North 88 degrees, 29 minutes 57 seconds East
(bearing assumed) along the last described parallel line, a
distance of 272.37 feet; thence South 00 degrees, 18 minutes, 45
seconds East, a distance of 653.24 feet to the center line of Bull
Valley Road, as dedicated by Dedication recorded November 30, 1972
as Document No. 607443; thence Northwesterly along said center
line, being a curve to the right and having a radius of 1432.40
feet, an arc distance of 399.55 feet to the West line of the
Northeast Quarter of said Southeast Quarter of Section 4; thence
North 00 degrees, 18 minutes, 42 seconds West along said West
line, a distance of 122.38 feet to the Northerly right of way line
of said Bull Valley Road; thence North 63 degrees, 21 minutes, 58
seconds West along the Northerly right of way line of said Bull
Valley Road, a distance of 173.29 feet to the intersection with
the center line as traveled of said Crystal Lake Road; thence
Northeasterly along said center line, being a curve to the left
and having a radius of 14323.60 feet, an arc distance of 480.96
feet to the point of beginning, in McHenry County, Illinois.

Exhibit "A".
That Plat of Survey of said real estate is attached hereto as
SECTION 2: The City Clerk is hereby directed to cause a certified
copy of this Ordinance, with said survey attached thereto to be recorded in
the Office of the Recorder of Deeds, McHenry County, Illinois. Following the
recordation of this Ordinance and said Plat of Survey of the real estate above
described and annexed, a copy thereof shall be filed in the Office of the
Clerk of McHenry County, Illinois.
SECTION 3: This Ordinance shall be in full force and effect from
and after its passage and approval according to Law.
