AU G 0 6 1990 CITy OF McHENRY ORDINANCE NO. 0-90-558 WHEREAS, your Petitioners, McHENRY STATE BANK, as Trustee under Trust #1380 and JAMES PASTERNOCK and SUSAN PASTERNOCK, have filed a Petition with the Zoning Board of Appeals of the City of McHenry requesting the amendment of the Zoning Ordinance of the City of McHenry and of such ordinance as amended in order to the following described real estate: The South 128.15 feet, as measured on the East line thereof, of that part of the Southwest Quarter of the Southwest Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the Northwest Corner of the Southwest Quarter of the Southwest Quarter of said Section 35; thence Easterly along the Quarter, Quarter Section line, a distance of 666.18 feet to the Westerly line of Illinois State Highway running in a Northerly and Southerly direction through said Southwest Quarter of the Southwest Quarter of said Section 35; thence Southerly along said Westerly line of Illinois State Highway, a distance of 646.51 feet; thence Westerly and parallel to said Quarter, Quarter Section line, a distance of 681.4 feet to the Westerly line of said Section 35; thence Northerly along said Section line, a distance of 646.6 feet to the place of beginning, in McHenry County, Illinois. • WHEREAS, the Petition requests reclassification of the subject property from its present classification which is DIAMOND. LESUEUR $ ROTH, ASSOCIATES ATTORNEYS 3431 W ELM STREET McHENRY ILLINOIS 815-385-6640 "RM-111 Low -Density Multi -Family Residential District, pursuant to the City of McHenry Zoning Ordinance, to "C_5" Highway Commercial District and a variation of the minimum lot width on the subject property from 200 feet to 128.15 feet, pursuant to the City of McHenry Zoning Ordinance, as amended; and WHEREAS, a hearing was held before the Zoning Board of Appeals in the manner and form as prescribed by Ordinance and Statute; and WHEREAS, as a result of said hearing, the taking of evidence and viewing of exhibits advanced thereat, the Zoning Board of Appeals of the City of McHenry did recommend to the City Council the granting of the requested reclassification of the subject premises to IIC-5" Highway Commercial District with a variation of the minimum lot width for the "C-511 Highway Commercial District from 200 feet to 128.15 feet; and WHEREAS, the City Council has considered the recommendation as submitted by the Zoning Board of Appeals. WHEREAS, the Zoning Board of Appeals and City Council did make the prerequisite findings necessary for the granting of the amendment and variation. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, McHenry County, Illinois, that the Zoning Ordinance and the Zoning Maps of the City of McHenry, and such ordinances and such maps as amended, be and the same are hereby amended, classifying the above described property 2 to "C-5" Highway Commercial District and the granting of said property a variation from the minimum lot width requirements of the "C-5" Highway Commercial District classification from 200 feet to 128.15 feet. This Ordinance shall be in full force and effect from '! and after its passage as provided by law. PASSED BY A MAJORITY OF THE CORPORATE AUTHORITIES OF THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, THIS 15th DAY OF August 1990.
