IN THE MATTER OF THE APPLICATION OF

TRUST NO. 4002, DATED APRIL 15, 1987,
and GRAIN MALL CENTER, LTD. FOR AN
AMENDMENT OF THE ZONING ORDINANCE
OF THE CITY OF McHENRY, McHENRY COUNTY,;
ILLINOIS.
Ordinance No. 0-90-557
WHEREAS, your Petitioners, McHENRY STATE BANK, as Trustee under Trust No.
4002, and GRAIN MALL CENTER, LTD., have filed a Petition with the Zoning Board
of Appeals of the City of McHenry requesting the amendment of the Zoning
Ordinance of the City of McHenry and of such ordinance as amended in regard to
the following described real estate:
PARCEL 1:
Beginning at a stake on the West line of Lot it of the County
Clerk's Plat of the South Half of Section 26, Township 45
North, Range 8 East of the Third Principal Meridian, the same
being the East line of the right of way of the Chicago and
Northwestern Railway Company,-376.1 feet South 12 degrees
East from an iron stake at the Northwest Corner of said
tot 11; thence North 77 h degrees East, 162 feet, more or
less, to the West line of the Borden's Condensed Milk
Company's right of way; thence South 12 degrees East along
said right of way 219.6 feet, more or less, to the center of
Waukegan Road; thence North 74.4 degrees West along the
center of said road, 176.2 feet, more or less, to the East
line of the right of way of the Chicago and Northwestern
Railway Company; thence North 12 degrees West along the East
line of said right of way, 118.9 feet, more or less, to the
place of beginning, in McHenry County, Illinois. ALSO
PARCEL 2:
All that part of the Southwest Quarter of Section 26,
Township 45 North, Range 8 East of the Third Principal
Meridian, lying Northerly of the center line of the Street,
now known as the Waukegan Road, described as follows:
Starting at a point in the center line of said Waukegan Road,
where the Easterly Tine of the right of way of the Chicago
and Northwestern Railway Company, intersects the same, said
point being also the Southwest Corner of Lot 11 of the County
Clerk's Plat of the South Half of Section 26, according to
the Plat thereof, recorded in the Recorder's Office of
McHenry County, Illinois, in Book 2 of Plats, page 38 and
running thence North 12 degrees West along the said Easterly
line of said right of way 118.9 feet to the Southwesterly
Corner of a piece of land conveyed by William Bonslett and
Wife, to Maggie B. Frett and Charles G. Frett, by Warranty
Deed dated December 16, 1912 and recorded in said Recorder's
Office, in Book 137 of Deeds, page 597, for a place of begin-
ning; thence North 12 degrees West along said Easterly line
of said right of way 169 feet, more or less, to the
Northwesterly corner of a piece of land conveyed by William
Spencer and Wife, to the L. Woodard Pickle Company by
Warranty Deed dated May 18, 1923 and recorded in said
Recorder's Office, in Book 168 of Deeds, page 108; thence
North 77 'k degrees East along the Northerly line of said
piece so conveyed to the L. Woodard Pickle Company, 162 feet,
more or less, to the Westerly line of a piece of land con-
veyed by Stafford and Goldsmith Company to Borden's Condensed
Milk Company by Warranty Deed dated December 17, 1901 and
recorded in said Recorder's Office, in Book 106 Deeds, page
151; thence South 12 degrees East, along said Westerly line
of the piece of land so conveyed to the Borden's Condensed
Milk Company, 169 feet, more or less, of the Southeasterly
Corner of the aforesaid piece of land conveyed to Maggie B'.
Frett and Charles G. Frett; thence South 77 �i degrees West,
along the Southerly line thereof, 162 feet, more or less, to
the place of beginning, in McHenry County, Illinois. ALSO
PARCEL 3:
All that part of the Southwest Quarter of Section 26,
Township 45 North, Range 8 East of the Third Principal
Meridian, lying Northerly of the center line of the Street,
now known as the Waukegan Road, described as follows:
Beginning at a point in the center line of said Waukegan Road
where the Easterly line of the -right of way of the Chicago
and Northwestern Railway Company, intersects the same, said
point being also the Southwest Corner of Lot 11 of the County
Clerk's Plat of the South Half of said Section 26, according
to the Plat thereof recorded in the Recorder's Office of
McHenry County, Illinois, in Book 2 of Plats, page 38 and
running thence North, 12 degrees West, along the said
Easterly line of said right of way, 287.9 feet, more or less,
to the Northwesterly corner of a piece of land conveyed by
William Spencer and Wife, to the L. Woodard Pickle Company by
Warranty Deed dated May 18, 1923, and recorded in said_
Recorder's•Office, in Book 168 of Deeds, page 108, fora
place of beginning; thence North, 77 Yz degrees East, along
the Northerly line of said piece so conveyed to the
L. Woodard Pickle Company, 162 feet, more or less, to the
Westerly line of a piece of land conveyed by Stafford and
Goldsmith Company to Borden's Condensed Milk Company by
Warranty Deed dated December 17, 1901 and recorded in said
Recorder's Office, in Book 106 of Deeds, page 151; thence
North 12 degrees West, along said Westerly line of the piece
of land so conveyed to the Borden Condensed Milk Company, 50
feet, more or less, to the Southeasterly Corner of a piece of

land conveyed by William Spencer and Wife, to Nick N. Freund
by Warranty Deed dated October 15, 1925 and recorded in said
Recorder's Office, in Book 175 of Deeds, page 583, thence
South 77 �i degrees West along the Southerly line of said
piece so conveyed to Nick N. Freund 162 feet, more or less,
to the said Easterly line of the right of way of the Chicago
and Northwestern Railway Company; thence South 12 degrees
East, along said Easterly line of said right of way, 50 feet,
more or less, to the place of beginning, in McHenry County,
Illinois.
PARCEL 4:
That part of the Southwest Quarter of Section 26, Township 45
North, Range 8 East of the Third Principal Meridian which
lies East of the right-of-way of the Elgin and State Line
Railroad (now known as the Chicago and Northwestern Railway)
bounded and described as follows: Commencing at a stake in
the center of the highway running from McHenry to Woodstock,
which stake is fifty feet from the center of the railroad
track and North 12 degrees West 34 feet from the Northwest.
Corner of Lot 9 in Block 3 of the Village Plat of West
McHenry; running thence North 12 degrees West 7 chains and 50
links 495 feet to a stake for the place of beginning; thence
South 12 degrees East along the aforesaid railroad right-of-
way line 157.1 feet, more or less, to the Northwest corner of
the Warranty Deed recorded in Book 175 of Deeds, page 365;
thence North 77h degrees East along the Northerly line of
book 175 of Deeds, page 365, 162 feet (more or less), to the
West line of the Borden's Condensed Milk Company's right-of-
way as recorded in Book 106 of Deeds, page 151; thence North
12 degrees West along said Westerly line, 56.4 feet, more or
less, to the North line of a Warranty Deed recorded in Book
56 of Deeds, page 164; thence North 74V4 degrees West along
the aforesaid North line, 2 chains and 67 links, more or
less, to the place of beginning, in McHenry County, Illinois.
WHEREAS, the Petition requests reclassification of the subject property
from its present classification which is "I-1" Industrial District, pursuant
to the City of McHenry Zoning Ordinance, to "0-2" Office Park District, pur-
suant to the City of -McHenry Zoning Ordinance, as amended; and
WHEREAS, a hearing was held before the Zoning Board of Appeals in the
manner and form as prescribed by Ordinance and Statute; and
WHEREAS, as a result of said hearing, the taking of evidence and viewing
of exhibits advanced thereat, the Zoning Board of Appeals of the City of
McHenry did recommend to the City Council the granting of the requested
reclassification of the subject premises to 110-2" Office Park District, con-

ditioned upon the property being developed as a single lot and with no access
directly on to Waukegan Road (State Route 120); and
WHEREAS, the City Council has considered the recommendation as submitted
by the Zoning Board of Appeals.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry,
McHenry County, Illinois, that the Zoning Ordinance and the Zoning Maps of the
City of McHenry, and such ordinances and such maps as amended, be and the same
are hereby amended, classifying the above described property to "0-2" Office
Park District with the conditions that the property be developed as a single
lot and with no access directly on to Waukegan Road (State Route 1z0).
This Ordinance shall be in full force and effect from and after its
passage as provided by law.
