HomeMy WebLinkAboutOrdinances - O-90-546 - 06/18/1990 - ANNEX AND RECLASS BUSCH PROPERTY FOR CONSTRUCTIOAUG 141990 ORDINANCE NO. 0-90-546 CITY OF MCHENRY AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN DESCRIBED REAL ESTATE TO THE EXISTING CORPORATE LIMITS OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS AND AMENDING THE ZONING ORDINANCE OF THE CITY OF MCHENRY MCHENRY COUNTY, ILLINOIS TO ZONE THE REAL ESTATE ANNEXED WHEREAS, Helen Busch, as Trustee under the provisions of Trust Agreement dated February 9, 1977 and known as Trust No. 100 is the record owner of the real estate hereinafter described; and WHEREAS, said real estate is contiguous to the existing corporate limits of the City of McHenry, McHenry County, Illinois and the Helen Busch, as Trustee aforesaid desires annexation of said real estate and has petitioned the City Council of the City of McHenry, Illinois, for annexation of said real estate; and WHEREAS, the Corporate Authorities for and on behalf of the City of McHenry, McHenry County, Illinois, have heretofore approved an Annexation Agreement bearing the date of the 18th day of June, 1990, between itself and Helen Busch, as Trustee under provisions of Trust Agreement No. 100 which provides in part for the annexation of said real estate to the existing corporate limits of the City of McHenry, McHenry County, Illinois and for the reclassification of the following described property to "RS-1" - Low Density Single Family Residential District; and the issuance of a Special Use Permit for public, library and/or educational use in order to allow the construction and operation of a Public Library, attendant services and administrative offices on the subject property; and WHEREAS, notice of public hearing before the City Council was published in the Northwest Herald, a newspaper of general circulation in the City of McHenry, within the time provided by law; and WHEREAS, the City Council has held a public hearing on said request for annexation, REOK.bED $-a3-q0 DOC---*qb E- 3112-9 NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS A FOLLOWS; SECTION I. The following described real estate be and the same is hereby annexed to and made part of the corporate limits of the City of McHenry, McHenry County, Illinois including and and all portion of adjacent street,s roads or highways as required by law: That part of the Northeast Quarter of Section 2, Township 44 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the Northwest corner of said Northeast Quarter of Section 2; thence South 01 degrees 00 minutes 48 seconds West (bearing assumed) along the North -South Quarter Section line of said Section 2, a distance of 764.72 feet; thence South 88 degrees 59 minutes 12 seconds East at right angles to the North -South Quarter Section line, being also the South line of lands described in Document No. 321453, a distance of 53.60 feet to the center line (as traveled) of Green Street, for the point of beginning; thence continuing South 88 degrees 59 minutes 12 seconds East, along the South line of land described in Document No. 321453 and along said line extended to the intersection with the East line of the West 933.39 feet of the North Half of said Northeast Quarter of Section 2; thence South 01 degrees 00 minutes 48 seconds West, along said East line, a distance of 528.58 feet to the South line of the North Half of said Northeast Quarter of Section 2; thence South 89 degrees 49 minutes 04 seconds West, along said South line of the North Half, a distance of 904.93 feet to the intersection of the center line (as traveled) of Green Street; thence North 03 degrees 38 minutes 38 seconds East, along said center line, a distance of 548.04 feet, to the point of beginning, in McHenry County, Illinois. SECTION II. The City Clerk is hereby directed to prepare an accurate map of the real estate described and annexed and when satisfied as to the accuracy of said map, record the map and a certified copy of this Ordinance in the Office of the Recorder of Deeds, McHenry County, Illinois. Following the recordation of this Ordinance and the map of the real estate above described and annexed, a copy thereof shall be filed in the Office of the Clerk of McHenry County, Illinois. -2- SECTION III. The real estate hereinabove annexed in Section I be and the same is hereby classified as "RS-1" - Low Density Single Family Residential District and a Special Use Permit is hereby issued for library, public, and educational uses in order to allow the construction and operation of a Public Library, attendant services and administrative offices on the subject property.. SECTION IV. All maps, plats, journals and other records, including the official city map of the corporate boundaries, official land use map of the Comprehensive Plan, and the zoning district map of the City of McHenry be and the same are hereby amended to reflect the annexation and the zoning of the real estate as described in Section I and III hereinabove. SECTION VI: This Ordinance shall be known as Ordinance No. 0-90-546and shall be in full force and effect from and after its passage and approval according to law. PASSED this 18th day of June , 1990.
