HomeMy WebLinkAboutOrdinances - O-90-540 - 05/14/1990 - KNOX PARTNERSHIP RECLAS TO C5Ok Vt<<.,F`iVI�� y i ORDINANCE NO. 0-90-540 P 0', 10 7990 ORDINANCE AMENDING THE ZONING llchzk� r ORDINANCE OF THE CITY OF McHENRY, ILLINOIS WHEREAS, the written Petition of the McHENRY STATE BANK, AS TRUSTEE UNDER A TRUST AGREEMENT DATED OCTOBER 6, 1980 AND KNOWN AS TRUST NO. 2088, 3510 WEST ELM STREET, McHENRY, ILLINOIS 60050; AND DORY BRODKIN, CONTRACT - PURCHASER, 950 SKOKIE BOULEVARD, NORTHBROOK, ILLINOIS 60062 (hereinafter referred to as "Petitioners"), has been filed with the City Clerk of the City of McHenry, Illinois, requesting the rezoning, under the provisions of the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, concerning the following described premises: That part of Lots 1 and 2 in the Northwest Quarter of Section 2, Township 44 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the Northwest corner of Lot 2 in said Northwest Quarter; thence Easterly, along the North line of said Lot 2, a distance of 817.54 feet to the Easterly right of way line of State Route No. 31; thence Southerly, along said Easterly right of way line, a distance of 610.0 feet for the place of beginning; thence Easterly, at right angles to the last described course, a distance of 480.09 feet to the East line of the West Half of Lots 1 and 2; thence Southerly along said East line, a distance of 724.13 feet to a point being 16 feet South of the South line of said Lot 2; thence Westerly, along a line being 16 feet South of and parallel to said South line, a distance of 460.28 feet to the Easterly right of way line of State Route No. 31 aforesaid; thence Northerly along said Easterly right of way line, a distance of 720.49 feet to the place of beginning, in McHenry, County, Illinois. Permanent Property Index No.: 14-02-100-026. WHEREAS, Petitioner, the McHENRY STATE BANK under the provisions of a Trust Agreement dated October 6, 1980, and known as Trust No. 2088, is the owner of the above described premises and the KNOX PARTNERSHIP, an Illinois General Partnership, is the owner of the beneficial interest in the aforesaid Trust; and, WHEREAS, Petitioners are requesting that the classification of the above described property be changed so that the entire property be classi- fied as "C-5" Highway Commercial Zoning; and, WHEREAS, based on the evidence heard, the Zoning Board of Appeals found that there was no overriding reason for not granting a change in zoning classification; and, WHEREAS, as a result of said hearing, the Zoning Board of Appeals did recommend to the City Council of �-he �,%ty of McHenry the granting of the Petitioners' prayer for rezoning; and, WHEREAS, at the regular meeting of the City Council held on May 14 , 1990, the Council did elect to consider the request of the Petitioners; and, WHEREAS, as a result of such consideration, the City Council of the City of McHenry did affirm the recommendation of the Zoning Board of Appeals of the City of McHenry concerning the prayer for rezoning as filed by the Petitioners; and, WHEREAS, the aldermen voting to accept the recommendation of the Zoning Board of Appeals concerning the subject Petition did find the facts to be sufficient to support the contentions as stated in the Petition. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, Illinois, as follows: That the property described above, being located within the City of McHenry, Illinois, be and is hereby reclassified as "C-5" Highway Commercial Zoning District; and, BE IT FURTHER ORDAINED that this Ordinance shall be in full force and effect from and after passage, approval and publication as provided by law.
