AN ORDINANCE REGULATING PARKING ALONG THE NORTH SIDE OF ELM STREET
(ROUTE 120) BETWEEN RIVERSIDE DRIVE AND RICHMOND ROAD (ROUTE 31)
IN THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS
WHEREAS, the City of McHenry, hereinafter known as "CITY", the County of
McHenry, and the State of Illinois, acting by and through its Department of
Transportation, Division of Highways, haye entered into an Agreement relative
to the improvement of Elm Street (Route 120) between Front Street (Route 31)
and Court Street; and
WHEREAS, in order to facilitate said improvement it is necessary for the
City to adopt an Ordinance regulating the parking on the north side of Elm
Street (Route 120) between Riverside Drive and Richmond Road (Route 31).
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois as follows:
SECTION 1: That it shall be unlawful for any person, firm or corporation
to park or cause to be parked a motor vehicle on the north side of Elm Street
(Route 120) from Riverside Drive to Richmond Road (Route 31).
SECTION 2: That any person, firm or corporation violating this Ordinance
shall be fined not less than $25.00 nor more than $500.00 for each offense,
and separate offenses shall be deemed committed for each and every day during
which a violation continues or exists.
SECTION 3: That if any section, paragraph, clause, phrase or part of
this Ordinance is for any reason held invalid, such decision shall not affect
the validity of the remaining provisions of this Ordinance, and the
application of these provisions to any persons or circumstances shall not be
affected thereby.
SECTION 4: That all Ordinances or parts of Ordinances in conflict with
the provisions of this Ordinance are hereby repealed insofar as they conflict
herewith.
SECTION 5: That this Ordinance shall be in full force and effect from
and after its passage and approval as provided by law.
