ORDINANCE NO. 0-90-523
AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
WHEREAS, an application for the issuance of a
conditional use permit under the Zoning Ordinance of the
City of McHenry, Illinois, for the construction and use of a
municipal building and local government offices, including
but not limited to a City Hall and Police Station on the
premises described in Section 1 hereof was duly filed and
regularly heard by the Zoning Board of Appeals, pursuant to
proper notice first having been given; and
WHEREAS, the subject property is zoned as "RS-1",
Low -Density Single -Family Residential District under the
terms and provisions of the City of McHenry, Illinois Zoning
Ordinance, and the Zoning Board of Appeals did expressly
find that the use of the subject property for a municipal
building and local government offices, including but not
limited to a City Hall and Police Station will be compatible
with the existing uses in the area and with permitted uses
in the zoning district in the following ways:
a. Traffic
Any adverse impact of types or volumes of traffic
flow not otherwise typical in the zoning district has been
minimized.
b. Environmental Nuisance
Any adverse effects of noise, glare, odor, dust,
waste disposal, blockage of light or air, or other adverse
environmental effects of a type or degree not characteristic
of Permitted Uses in the zoning district, have been
appropriately controlled.
c. Neighborhood Character
The proposed use will fit harmoniously with the
existing natural or man-made character of its surroundings,
and with Permitted Uses in the zoning district. The use
will not have undue deleterious effect on the environmental
quality, property values, or neighborhood character already
existing in the area or normally associated with Permitted
Uses in the district.
d. Public Services and Facilities
The proposed use will not require existing
community facilities or services to a degree
disproportionate to that normally expected of Permitted Uses
in the district, nor generate disproportionate demand for
new services or facilities, in such a way as to place undue
burdens upon existing development in the area.
e. Public Safetv and Health
The proposed use will not be detrimental to the
safety or health of the employees, patrons, or visitors
associated with the use nor of the general public in the
vicinity.
and did recommend to the City Council that said conditional
use be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF MCHENRY, ILLINOIS as follows:
SECTION 1: That the City Council hereby expressly
finds that:
a. Traffic

waste disposal, blockage of light or air, or other adverse

SECTION 2: That a Conditional Use Permit is hereby
granted to the City of Mchenry, Illinois to construct and to
operate municipal building and local government offices,
including but not limited to a City Hall and Police Station
on the following described premises:
Parcel 1:
The East Half of Government Lot 1 in the Northwest Quarter of Sect=an 2
(excepting therefrom the North 330.93 feet (as measured along the Easter-
ly and Westerly lines thereof) and excepting therefrom that part thereof
described as follows: Beginning at the Southeast corner of said c__-t Half;
thence North 89 degrees, 37 minutes, 33 seconds West, bearing assuoed, alona
the South line of said East Half, a distance of 1306.61 feet to t_}-e Southwest
corner of said East Half; thence North 00 degrees, 55 minutes, 03 seconds
East along the West line of said East Half, a distance of 650.06 feet to a
point; thence South 89 degrees, 41 minutes, 51 seconds East, a distance of
1312.27 feet to the East line of said East Half; thence South 01 degrees,
24 minutes, 51 seconds West along said East line, a distance of 651.78 feet
to the point of beginning), Township 44 North, Range 8 East of the Third
Principal Meridian, in McHenry County, Illinois.
Parcel 2:
The North 330.93 feet (as measured along the Easterly and Westerly 1---,es)
of the East Half of Government Lot 1 in the Northwest Quarter of Sec- on
21 Township 44 North, Range 8 East of the Third Principal Meridian,
McHenry County, Illinois.
SECTION 3: All ordinances or parts thereof in conflict
herewith be and the same are hereby repealed to the extent
of such conflict.
SECTION 4: That all maps, plans, journals and other
records including the Zoning District Map of the City of
McHenry, be and the same are hereby amended to reflect the
granting of the Conditional Use Permit to the above
described real estate.
SECTION 5: That this ordinance shall be in full force
and effect from and after its passage and approval as
required by law.
