AN ORDINANCE PROVIDING FOR THE ANNEXATION
OF CERTAIN DESCRIBED REAL ESTATE TO THE JUL ' 1989
EXISTING CORPORATE LIMITS OF THE
CITY OF McHENRY, McHENRY COUNTY, ILLINOIS Ciff OF MMENRY
AND AMENDING THE ZONING ORDINANCE OF
THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS
TO ZONE THE REAL ESTATE ANNEXED
WHEREAS, the Cosmopolitan National Bank of Chicago, as
Trustee under the provisions of Trust Agreement Known as Trust
No. 28571 is the record owner the real estate hereinafter
described; and
WHEREAS, said real estate is contiguous to the
existing corporate limits of the City of McHenry, McHenry County,
Illinois, and the Cosmopolitan National Bank of Chicago, as
Trustee aforesaid desires annexation of said real estate and has
petitioned the City Council of the City of McHenry County,
Illinois, for annexation of said real estate; and
WHEREAS, the Corporate Authorities for and on behalf
of the City of Mchenry, McHenry County, Illinois, have heretofore
approved an Annexation Agreement bearing the date of the jqtO day
of 1989, between itself and the Cosmopolitan National
Bank of Chicago, as Trustee under the provisions of Trust
Agreement No. 28571 which provides in part for the annexation of
said real estate to the existing corporate limits of the City of
McHenry, McHenry County, Illinois and for the reclassification of
the following described property to "I-1" Industrial District; and
WHEREAS, notice of public hearing before the City
Council was published in the Northwest Herald, a newspaper of

general circulation in the City of McHenry within the time
provided by law; and
WHEREAS, the City Council has held a public hearing on
said request for annexation,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS AS FOLLOWS:
SECTION I: The following described real estate be
and the same is hereby annexed to and made part of the corporate
limits of the City of McHenry, McHenry County, Illinois,
including any and all portions of adjacent streets, roads or
highways as required by law:
Parcel "A"
That part of the Northeast Quarter of Section 10, Township 44
North, Range 8 East of the Third Principal Meridian, described as
follows: Commencing at the Northwest corner of said Northeast
Quarter; thence South 89057120" East, along the North line of
said Northeast Quarter, 1656.55 feet to the place of beginning;
thence South 89*57120" East, along said North line of said
Northeast Quarter, 917.37 feet to the Westerly right-of-way line
of Illinois State Route 31; thence Southwesterly along the arc of
a curve to the right, said curve having a radius of 11419.00
feet, an arc of 875.09 feet and a chord bearing South 25008159"
West, 874.88 feet; thence South 27020125" West, along said
right-of-way line, 310.00 feet; thence North 62039135" West,
848.66 feet; thence North 27020125" East, 763.55 feet to the
place of beginning and containing 18.9122 acres, more or less, in
McHenry County, Illinois.
Parcel "B"
That part of the Northeast Quarter of Section 10, Township 44
North Range 8 East of the Third Principal Meridian, described as
follows: Commencing at the Northwest corner of said Northeast
Quarter; thence South 89057120" East, along the North line of
said Northeast Quarter, 1656.55 feet; thence South 27*20125" West
763.55 feet to the place of beginning; thence continuing South
27620125" West, 1024.85 feet; thence South 89048102" East,
953.67 feet to the Westerly right-of-way line of Illinois State
Route 31; thence North 27*20125" East, along said right-of-way
line, 589.81 feet; thence North 62039135" West, 848.66 feet to
the place of beginning and containing 15.7288 acres, more or
less, in McHenry County, Illinois.

That part of the Northeast Quarter and the Northwest Quarter of
Section 10, Township 44 North Range 8 East of the Third Principal
Meridian, described as follows: Beginning at the Northeast
corner of said Northwest Quarter; thence North 89*4912311 West
along the North line of said Northwest Quarter, 468.92 feet;

East, 1120.00 feet; thence North 2702012511 East, 1788.40 feet to
the North line of said Northeast Quarter; thence North 890571201

That part of the Northeast Quarter and the Northwest Quarter of

Principal Meridian and the Northeast Quarter of Section 9,
Township 44 North, Range 8 East of the Third Principal Meridian,
described as follows: Commencing at the Northwest corner of said
Northeast Quarter; thence South 002713811 West, along the West
line of said Northeast Quarter, 1587.01 feet to the place of
beginning; thence North 89*4810211 West, 2772.54 feet to the
Easterly right-of-way line of the Chicago and Northwestern
Railway; thence Southwesterly along said right-of-way being the

feet, an arc of 210.26 feet and a chord bearing South 1000514411

That part of the Northwest Quarter of Section 10, Township 44
North, Range 8 East of the Third Principal Meridian, described as
follows: Commencing at the Northeast corner of said Northwest
Quarter; thence North 89*4912311 West, along the North line of
said Northwest Quarter, 468.92 feet to the place of beginning;
thence continuing North 8904912311 West, along said North line
1750.00 feet to the Easterly right-of-way line of the Chicago and
Northwestern Railway; thence Southwesterly along the arc of a
curve to the left, said curve having a radius of 5679.59 feet, an
arc of 1688.57 feet and a chord bearing South 1904012411 West,
1682.36 feet; thence South 89048102 East, 2500.48 feet; thence

North 603615511 West, 1598.10 feet to the place of beginning and
containing 79.0149 acres, more or less, in McHenry County,
Illinois.
SECTION II:
The City Clerk is hereby directed to
prepare an accurate map of the real estate described and annexed
and when satisfied as to the accuracy of said map, record the map
and a certified copy of this Ordinance in the Office of the
Recorder of Deeds, McHenry County, Illinois. Following the
recordation of this Ordinance and the map of the real estate
above -described and annexed, a copy thereof shall be filed in the
Office of the Clerk of McHenry County, Illinois.
SECTION III: That the real estate hereinabove
annexed in Section I be and the same is hereby classified as
"I-1" Industrial District.
SECTION IV: That in addition to the Rezoning
Classification of the Subject Property, set forth in Section III,
the Permitted Uses listed in Groups P & R, Table 9, of the
present Zoning Ordinance shall be allowed as additional Permitted
Uses of the Subject Property, and that any of the uses listed in
Groups F., G, H, I, J, K, N & O of said Table 7 and Groups Q and
S of Table 9 of the present zoning ordinance may be established
on the Subject Premises as a Conditional Use subject to
compliance with the approval process provided in the Zoning
Ordinance for conditional Use Permits.
SECTION V:
All maps, plats, journals and other
records, including the official city map of the corporate

boundaries, official land use map of the Comprehensive Plan, and
the zoning district map of the City of McHenry be and the same
are hereby amended to reflect the annexation and the zoning of
the real estate as described in Sections I and III hereinabove.
SECTION VI: This Ordinance shall be known as
Ordinance No.0• -Oland shall be in full force and effect from
and after its passage and approval according to law.
