HomeMy WebLinkAboutOrdinances - O-89-497 - 07/05/1989 - GRANT ZONING JOHN AND JUDITH HUFFI • CRDINANCE AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF McHENRY, ILLINOIS WHEREAS, a Petition was filed with the City Clerk of McHenry, Illinois by JOHN J. HUFF and JUDITH E. HUFF requesting a variation and amendment under the provisions of the City of McHenry Zoning Ordi_nanre as amended for the following described property, to wit: That part of Lot 2 of the County Clerk's Pi at of the Northeast Quarter of the Northeast Quarter of Section 24, Township 45 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the most Southerly Corner of said Lot 2; thence Northwesterly along the Northeasterly line of Logan Street, 70 feet; thence Northeasterly parallel to the Southeasterly line of said Lot 2, 157.62 feet; thence Southeasterly parallel to the Southwesterly line of said Lot 2, 70 feet to a point in the Southeasterly line of said Lot 2; thence Southwesterly along the Southeasterly line of said Lot to the place of beginning, said County Clerk's Plat being recorded May 6, 1902, as Document No. 14093z in Book 2 of Plats, page 45, in McHenry County, Illinois. WHEREAS, JOHN J. HUFF and JUDY HUFF are the owners cf said property and; WHEREAS, the property is presently classified "--1,.S-4" Residential District and whereas the Petitioners have requested a variation of the interior side yard requirement to permit construction of a garage addition up to within three (3) feet of the Easterly line and; WHEREAS, a hearing was held on said Petition before the City of McHenry Zoning Board Of Appeals on the 19th day of June, i989, and; WHEREAS, the Zoning Board of Appeals did find that the approval criteria for a variation, as set forth in Table 32 of the Zoning Ordinance, have been met and; WHEREAS, the Zoning Board of Appeals did recommend that the variation requested be granted and; WHEREAS, as a result of said hearing the Zoning Board of Appeals did make its report and recommendation to the City Council; NOW, THEREFORE, be it ordained by the City Council of the City of McHenry, Illinois, that a variation of the City of McHenry Zoning Ordinance side yard requirement for said property is hereby granted to permit a garage addition to the existing residence to within three (3) feet of the Easterly lot line. BE IT FURTHER ORDAINED that this Ordinance shall be in full force and effect from and after its passage and approval as provided by Law.
