AN ORDINANCE
WHEREAS, the Northern Illinois Gas Company, Illinois
Bell Telephone Company and the Commonwealth Edison Company
have indicated that they have no facilities located on the
utility easement hereinafter described and have disclaimed
all right, title and interest acquired therein as a result
of the A. M. Kaufman Subdivision recorded as Document No.
766157; and,
WHEREAS, the City of McHenry has no facilities located
in the utility easement hereinafter described and
anticipates no further need thereof.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF MCHENRY, ILLINOIS as follows:
SECTION 1. That the following described easement be
and the same is hereby vacated:
Along the East line of Lots 8 and 9 and the West line
of Lot 7 in A. M. Kaufman Subdivision, being a Subdivision
of part of the West Half of the Northeast Quarter of Section
28, Township 45 North, Range 8 East of the Third Principal
Meridian according to the Plat thereof recorded April 27,
1979 as Document No. 766157 in McHenry County, Illinois.
SECTION 2. All ordinances, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of such conflict.
SECTION 3. This ordinance shall be published in
pamphlet form by and under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 4. This ordinance shall be in full force and
effect from and after its passage, approval and publication
in pamphlet form, as provided by law.
