HomeMy WebLinkAboutOrdinances - O-89-493 - 03/01/1989 - GRANT VARIANCE TO CUNAT ALLOWING 1`0 PRINCIPAL BLDFINAL STATE OF ILLINOIS ) COUNTY OF McHENRY ) SS CITY OF McHENRY ) IN THE MATTER OF THE APPLICATION OF ) CUNAT BROTHERS, INC., FOR A VARIATION OF ) THE ZONING ORDINANCE OF THE CITY OF ) ORDINANCE NO.0-89-493 McHENRY, McHENRY COUNTY, ILLINOIS. ) ORDINANCE GRANTING A VARIATION WHEREAS, your Petitioner, CUNAT BROTHERS, INC., has filed a Petition with the Zoning Board of Appeals of the City of McHenry requesting a variation of the Zoning Ordinance of the City of McHenry in regard to the following described real estate: The East 2251.31 feet of the Southeast Quarter of Section 3, Township 44 North, Range 8 East of the Third Principal Meridian, (excepting therefrom the North 1867.0 feet, AND ALSO excepting therefrom that property described in J.B. and Clara Subdivision, being a part of Sections 2 and 3, Township 44 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded November 13, 1985 as Document No. 923371), in McHenry County, Illinois. WHEREAS, the Petition requests a variation on the subject property allowing ten (10) principal buildings; and WHEREAS, a hearing on said Petition was held before the Zoning Board of Appeals of the City of McHenry in the manner and the form as prescribed by Ordinance and Statute; and WHEREAS, as a result of said hearing, the taking of evidence, and the viewing of exhibits advanced thereat, the Zoning Board of Appeals of the City of McHenry did recommend to the City Council of the City of McHenry the granting of the variation allowing ten (10) principal buildings, subject to the following conditions: (a) The ten (10) principal buildings to be constructed on the subject property shall be built in accordance with the Site Plan dated 1/31/89 prepared by Mark A. Elmore, which is attached as Exhibit "A". (b) The underground utilities shall be extended on site in accor- dance with City standards set forth in the City's Subdivision Control Ordinance. (c) The basis for review and approval of the underground utilities would be in accordance with the standards established by the Subdivision Control Ordinance of the City of McHenry Section VIII. (d) The City shall be granted an option to acquire the ownership of the water mains without charge and the terms and conditions of the easements shall be acceptable to the City. (e) The paved roadways shall be a minimum width of 24 feet and shall include a curb and gutter which comply with applicable City spe- cifications. The roadways shall have a minimum 8 inch gravel base and a minimum 3 inches of bituminous surface. WHEREAS, the Zoning Board of Appeals and the City Council have each made the findings that the Approval Criteria for Variances (pages 376-377 of the Zoning Ordinance) have been met; and WHEREAS, the City Council has considered the recommendation as submitted by the Zoning Board of Appeals. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, McHenry County, Illinois as follows: SECTION 1: That the Zoning Ordinance and the Zoning Maps of the City of McHenry, and such Ordinance and such Maps as amended, be and the same are hereby amended to allow a variation on the above described real estate so as to allow ten (10) buildings on a single parcel subject to the following con- ditions: (a) The ten (10) principal buildings to be constructed on the subject property shall be built in accordance with the Site Plan dated 1/31/89 prepared by Mark A. Elmore, which is attached as Exhibit "A".
