AN ORDINANCE PROHIBITING ENCROACHMENTS WITHIN THE
STATE OF ILLINOIS RIGHT OF WAY ALONG ILLINOIS ROUTE 31/120
WHEREAS,
the State of Illinois acting
by and through
its Department
of Transportation is desirous of improving
Illinois Route
311120 between
Third Street
and Richmond Road in the City of
McHenry; and
WHEREAS,
sain project is being constructed in order to
facilitate the
Free flow of
traffic and ensure safety to the
motoring public;

WHEREAS,
said project passes through the
City of McHenry.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Mc HENRY, COUNTY OF
McHENRY, STATE OF ILLINOIS as follows:
SECTION 1. That no person, firm, corporation or other en-1 ity shall
install, place, maintain or construct any structure that encroaches upon the
state of Illinois right of way on Illinois Route 31 /120 within the limits of
+,he City of McHenry.
SECTION 2. The City Clerk of the City of McHenry is hereby authorized
.ind directed to attach a copy of this Ordinance to the Agreement dated
November 16, 1988, by and between the State of Illinois and the City of
McHenry relative to the improvement of Illinois Route 31 /120.
SECTION 3. This Ordinance shall be in full force and effect; from and
sifter its passage, approval and publication as provided by law.
