ORDINANCE AUTHORIZING SALE OF MUNICIPALLY
OWNED REAL ESTATE
WHEREAS, the City of McHenry, Illinois owns the
following described real estate:
South Half of part of Lot One (1) of County Clerk's
Plat (.20) Acres Dr. 337 P. 591 Section 26 Township 45
Range 8, McHenry Township, McHenry, Illinois.
ALSO KNOWN AS
That part of the Northeast Quarter of the Southwest
Quarter of Section 26 and being a part of Lot 1 of the
County Clerk's Plat of said Section, described as
follows: Commencing at the Southeast corner of Lot 17
of Mill Stream Addition to McHenry, Unit No. 1,
according to the Plat thereof recorded July 16, 1946 as
Document No. 193334 in Book 10 of Plats, page 33;
thence East on the North line of Kent Avenue 60 feet to
a point; thence North on a line parallel with the East
line of Lot 17, aforesaid a distance of 85 feet to a
point for a place of beginning; thence North on a
continuation of the last described line 100.5 feet to
the East and West Quarter Section line; thence East on
said Quarter Section line 86 feet to a point; thence
South on a line parallel with the East line of said Lot
17 a distance of 102.11 feet, more or less, to a point
85 feet North from the North line of Kent Avenue,
aforesaid; thence West parallel with the North line of
said Kent Avenue 86 feet to the place of beginning, all
in Township 45 North, Range 8 East of the Third
Principal Meridian, in McHenry County, Illinois.
WHEREAS, the Corporate Authorities of the City of
McHenry have determined that it is no longer necessary,
appropriate, or in the best interest of the City of McHenry,
Illinois that it retain title to said real estate and that
said real estate is not required for the use of, or
profitable to the municipality; and
WHEREAS, pursuant to Section 11-76-2 of the Illinois
Municipal Code, Illinois Revised Statutes, Chapter 24,
notice has been given of the proposal to sell such real
estate and bids have been invited for the purchase of such
real estate, said notice having first been published on
June 9, 1988, and having been published for three successive
weeks in the Northwest Herald.
WHEREAS, pursuant to said notice, bids were opened at
the regular meeting of the City Council held July 13, 1988;
and,
WHEREAS, the Corporate Authorities of the City of
McHenry, Illinois find and determine that the best interest
of the City of McHenry, Illinois and of its residents will
be served by the acceptance of the bid submitted by Jay
Koeller and the sale of the aforesaid real estate to such
bidder for the amount bid of $17,600.00, which amount
represents the high bid.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: The Corporate Authorities of the City of
McHenry, Illinois find as facts the recitals hereinabove set
forth.
SECTION 2: The bid of Jay Koeller in the amount of
$17,600.00 is hereby accepted by the Corporate Authorities
of the City of McHenry, Illinois for the sale of the above
described real estate.
SECTION 3: The Mayor is hereby authorized and directed
to sign and the City Clerk is hereby authorized and directed
to execute a contract for the sale and purchase of the
aforesaid real estate which contract shall be in the form
attached hereto as Exhibit A.
SECTION 4: Upon satisfaction of the terms of the
aforesaid contract and upon payment or securing of the
aforesaid bid price in the manner provided in said contract,
the Mayor is hereby authorized and directed to convey and
transfer the aforesaid real estate to the successful bidder
named in Section 2 hereof by a proper Deed of Conveyance,
stating therein the aforesaid consideration, and the City
Clerk is hereby authorized to acknowledge and to attest such
Deed and to affix thereto the sale of the City of McHenry,
Illinois.
SECTION 5: The Mayor and City Clerk are hereby
authorized, respectively, to execute and attest such other
documents as may be necessary to the conveyance herein
authorized.
SECTION 6: This ordinance shall be in full force and
effect from and after its passage, by a vote of at least
3/4ths of the Corporate Authorities now holding office, and
approval in the manner provided by law.
