HomeMy WebLinkAboutOrdinances - O-88-472 - 07/18/1988 - AUITHORIZE SALE OF CITY PROPERTY TO JAKE AND ASSOCORDINANCE NO. 0-88-472 ORDINANCE AUTHORIZING SALE OF MUNICIPALLY OWNED REAL ESTATE WHEREAS, the City of McHenry, Illinois owns the following described real estate: Part of the Northwest Quarter of the Southwest Quarter of Section 26, Township 45 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning on the East and West Quarter Section line at a point 795.13 feet East from the West Quarter corner of said Section 26; thence Southerly at right angles to said Quarter Section line, a distance of 164 feet to a point; thence Easterly parallel to said East and West Quarter Section line 445 feet to a point; thence Northerly at right angles to the last described line 164 feet to an intersection with said East and West Quarter Section line; thence West on said Quarter Section line, a distance of 449 feet to the place of beginning, (excepting that part of the Northwest Quarter of the Southwest Quarter of said Section 26, described as follows: Beginning on the East and West Quarter Section line at a point 795.13 feet East from the West Quarter corner of said Section 26; thence Southerly at right angles to said Quarter Section line, a distance of 164 feet to a point; thence Easterly parallel to said East and West Quarter Section line 75 feet to a point; thence Northerly at right angles to the last described line 164 feet to an intersection with said East and West Quarter Section line; thence West on said Quarter Section line, a distance of 75 feet to the place of beginning; Also excepting that part of the Northwest Quarter of the Southwest Quarter of said Section 26, described as follows: Beginning on the East and West Quarter Section line at a point 870.13 feet East from the West Quarter corner of said Section 26; thence Southerly at right angles to said Quarter Section line, a distance of 164 feet to a point; thence Easterly parallel to said East and West Quarter Section line 75 feet to a point; thence Northerly at right angles to the last described line 164 feet to an intersection with said East and West Quarter Section line; thence West on said Quarter Section line, a distance of 75 feet to the place of beginning; Also excepting that part of the Northwest Quarter of the Southwest Quarter of said Section 26, described as follows: Beginning on the East and West Quarter Section line at a point 945.13 feet East from the West Quarter corner of said Section 26; thence Southerly at right angles to said Quarter Section line, a distance of 164 feet to a point; thence Easterly parallel to said East and West Quarter Section line, 75 feet to a point; thence Northerly at right angles to the last described line 164 feet to an intersection with said East and West Quarter Section line; thence West on said Quarter Section line, a distance of 75 feet to the place of beginning; Also excepting that part of the Northwest Quarter of the Southwest Quarter of said Section 26, described as follows: Beginning on the East and West Quarter Section line at a point 1020.13 feet East from the West Quarter corner of said Section 26; thence Southerly at right angles to said Quarter Section line, a distance of 164 feet to a point; thence Easterly parallel to said East and West Quarter Section line 75 feet to a point; thence Northerly at right angles to the last described line 164 feet to an intersection with said East and West Quarter Section line; thence West on said Quarter Section line, a distance of 75 feet to the place of beginning), in McHenry County, Illinois. WHEREAS, the Corporate Authorities of the City of McHenry have determined that it is no longer necessary, appropriate, or in the best interest of the City of McHenry, Illinois that it retain title to said real estate and that said real estate is not required for the use of, or profitable to the municipality; and WHEREAS, pursuant to Section 11-76-2 of the Illinois Municipal Code, Illinois Revised Statutes, Chapter 24, notice has been given of the proposal to sell such real estate and bids have been invited for the purchase of such real estate, said notice having first been published on June 9, 1988, and having been published for three successive weeks in the Northwest Herald. WHEREAS, pursuant to said notice, bids were opened at the regular meeting of the City Council held July 13, 1988; and, WHEREAS, the Corporate Authorities of the City of McHenry, Illinois find and determine that the best interest of the City of McHenry, Illinois and of its residents will be served by the acceptance of the bid submitted by Jake & Associates and the sale of the aforesaid real estate to such bidder for the amount bid of $17,795.00, which amount represents the high bid. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION l: The Corporate Authorities of the City of McHenry, Illinois find as facts the recitals hereinabove set forth. 2 SECTION 2: The bid of Jake & Associates in the amount of $17,795.00 is hereby accepted by the Corporate Authorities of the City of McHenry, Illinois for the sale of the above described real estate. SECTION 3: The Mayor is hereby authorized and directed to sign and the City Clerk is hereby authorized and directed to execute a contract for the sale and purchase of the aforesaid real estate which contract shall be in the form attached hereto as Exhibit A. SECTION 4: Upon satisfaction of the terms of the aforesaid contract and upon payment or securing of the aforesaid bid price in the manner provided in said contract, the Mayor is hereby authorized and directed to convey and transfer the aforesaid real estate to the successful bidder named in Section 2 hereof by a proper Deed of Conveyance, stating therein the aforesaid consideration, and the City Clerk is hereby authorized to acknowledge and to attest such Deed and to affix thereto the sale of the City of McHenry, Illinois. SECTION 5: The Mayor and City Clerk are hereby authorized, respectively, to execute and attest such other documents as may be necessary to the conveyance herein authorized. SECTION 6: This ordinance shall be in full force and effect from and after its passage, by a vote of at least 3/4ths of the Corporate Authorities now holding office, and approval in the manner provided by law.
