THE CITY OF McHENRY, ILLINOIS.
WHEREAS, your Petitioners, THE McHENRY SAND & GRAVEL COMPANY, INC. and
GERSTAD BUILDERS, INC., have filed a Petition with the Zoning Board of Appeals
of the City of McHenry requesting an amendment and variation of the Zoning
Ordinance of the City of McHenry and of such ordinance as amended in regard to
lithe following described real estate:
it PARCEL 1:
The North 30 feet, (as measured along the East line thereof),
I' of the East 452.18 feet, (as measured along the North line
thereof), of the Northwest Quarter of Section 28, Township 45
North, Range 8 East of the Third Principal Meridian, in
McHenry County, Illinois. ALSO
PARCEL 2:
Part of the Northwest Quarter of Section 28, Township 45
North, Range 8 East of the Third Principal Meridian,
described as follows: Commencing at the Northeast corner of
said Northwest Quarter and running thence South 00 degrees,
46 minutes, 25 seconds West, (bearing assumed), along the
East line thereof, a distance of 30.00 feet to a point, for a
place of beginning; thence continuing South 00 degrees, 46
minutes, 25 seconds West, along said East line, a distance of
274.07 feet; thence South 89 degrees, 08 minutes, 04 seconds
West, parallel with the North line of said Northwest Quarter,
a distance of 452.18 feet; thence North 00 degrees, 46 minu-
tes, 25 seconds East, parallel with the East line of said
Northwest Quarter, a distance of 274.07 feet; thence North 89
degrees, 08 minutes, 04 seconds East, parallel with the North
!, line of said Northwest Quarter, a distance of 452.18 feet to
the point of beginning, in McHenry County, Illinois. ALSO

Ij WHEREAS, the Zoning Board of Appeals and the City Council have each made
the findings that the approval criteria for a variation as provided for by the
City of McHenry Zoning Ordinance and by Statute have been met; and
WHEREAS, as a result of said hearing, the taking of evidence and viewing
of exhibits advanced thereat, the Zoning Board of Appeals of the City of
McHenry did recommend to the City Council the granting of the requested
II reclassi-`ication of the subject premises to "RM-1" Low -Density Multi -Family
III Residential District with a variation allowing the construction of up to 11
buildings; and
WHEREAS, the City Council has considered the recommendation as submitted
by the Zoning Board of Appeals.

NOW, THEREFORE, BE IT ORDAINED that the Zoning Ordinance and the Zoning
Maps of the City of McHenry, and such ordinances and such maps as amended, be
and the same are hereby amended, reclassifying the above described property
from "A -III Agriculture with a variation to IIRM-1" Low -Density Multi -Family
Residential District with a variation allowing the construction of up to 11
buildings with the number of dwelling units not to exceed 33.

This Ordinance shall be in full force and effect from and after its

passage as by law provided.
