TO THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS
WHEREAS, a Petition was filed with the City of McHenry, McHenry County,
Illinois on May 6, 1988 requesting a hearing on the content of a proposed
Annexation Agreement by and between THE McHENRY SAND & GRAVEL COMPANY, INC.
and GERSTAD BUILDERS, INC., hereinafter referred to collectively as "Owner";
and
WHEREAS, hearings were had in regard to said Annexation Agreement before
the Mayor and City Council; and
WHEREAS, as a result of such hearings, and consideration of the evidence
given and exhibits presented, the Mayor and City Council have determined that
the request of the Petition, as amended, taken in concert with the Annexation
Agreement, as amended, and the exhibits which are a part thereof, is in har-
mony and keeping with the proper and orderly development and improvement of
the City of McHenry.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City
of McHenry, McHenry County, Illinois as follows:
1. That the Annexation Agreement, as amended, as presented to the City
by said applicants, be and the same is hereby approved and shall be properly
executed by the Mayor and City Clerk on behalf of the City of McHenry, as by
statute authorized and provided, and that a true and correct copy of said
Annexation Agreement is on file in the City Clerk's Office.
2. That the property described on Exhibit "A" attached hereto and by
this reference made a part hereof be and the same is hereby annexed to the
City of McHenry, a municipal corporation in the State of Illinois.
3. That this Ordinance is adopted pursuant to a Petition signed by the
owners of record of all the land in the aforesaid described territory and

PARCEL 1:
The North 30 feet, (as measured along the -East line thereof), of the East
452.18 feet, (as -measured along the North line thereof), of the Northwest
Quarter of Section 28, Township 45 North, Range 8 East of the Third Principal
Meridian, in McHenry County, Illinois. ALSO
PARCEL 2:
Part of the Northwest Quarter of Section 28, Township 45 North, Range 8 East
of the Third Principal Meridian, described as follows: Commencing at the
Northeast corner of said Northwest Quarter and running thence South 00
degrees, 46 minutes, 25 seconds West, (bearing assumed), along the East line
thereof, a distance of 30.00 feet to a point, for a place of beginning; thence
continuing South 00 degrees, 46 minutes, 25 seconds West, along said East
line, a distance of 274.07 feet; thence South 89 degrees, 08 minutes, 04
seconds West, parallel with the North line of said Northwest Quarter, a
distance of 452.18 feet; thence North 00 degrees, 46 minutes, 25 seconds East,
parallel with the East line of said Northwest Quarter, a distance of 274.07
feet; thence North 89 degrees, 08 minutes, 04 seconds East, parallel with the
North line of said Northwest Quarter, a distance of 452.18 feet to the point
of beginning, in McHenry County, Illinois. ALSO

said Northwest Quarter, a distance of 304.07 feet for a point of beginning;
thence continuing South 00 degrees, 46 minutes, 25 seconds West, along said
East line, a distance of 603.49 feet; thence North 89 degrees, 14 minutes, 50
seconds West, a distance of 452.00 feet; thence North 00 degrees, 46 minutes,
25 seconds East, parallel with the East line of said Northwest Quarter, a
distance of 590.67 feet; thence North 89 degrees, 08 minutes, 04 seconds East,
parallel with the North line of said Northwest Quarter, a distance of 452.18
feet to the point of beginning, in McHenry County, Illinois.

there are no electors residing thereon; that all of said territory is not
within the corporate limits of any municipality and is contiguous to the cor-
porate limits of the City of McHenry, McHenry County, Illinois.
4. That attached hereto and made a part hereof is an accurate map of
said territory marked Exhibit "B".
5. That this Ordinance shall be in full force and effect from and after
its passage and adoption according to law.
