AN ORDINANCE
WHEREAS, the corporate authorities are authorized by
the terms and provisions of Section 11-91-1 et. seq. of the
Illinois Municipal Code to vacate any part of any public
street; and,
WHEREAS, it is the judgment and determination of the
corporate authorities of the City of McHenry, Illinois that
the public interest will be subserved by vacating that part
of the street hereinafter described in Section 1 of this
ordinance.
NOW, THEREFORE, be it ordained by the City Council of
the City of McHenry, McHenry County, Illinois, as follows:
SECTION 1. That part of Bally Road abutting upon and
located West of Lot 5 in Block 5 in McHenry Shores Unit
Number 1 Subdivision in McHenry County, Illinois be and the
same is hereby vacated, but reserving to the City of
McHenry, Illinois a perpetual unlimited easement thereon for
storm water drainage and municipal utility purposes.
SECTION 2. This ordinance shall be published in
pamphlet form under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 3. A certified copy of this ordinance shall be
recorded with the McHenry County Recorder of Deeds.
SECTION 4. This ordinance shall be in full force and
effect only when the owners of the property abutting upon
the aforesaid part of Bally Road vacated hereby shall each
pay to the City the sum of $_ 500.00
PASSED this 15th _ day of June __1 1988 by
affirmative vole of three-four the of the members of the City
Council holding office.
