OF THE CITY OF MC HENRY, ILLINOIS )
WHEREAS, the Petitioner, the Board of Education of McHenry
Community Consolidated School District No. 15, McHenry and Lake
Counties, Illinois, filed a Petition and an Amended Petition
with the Zoning Board of Appeals of the City of McHenry requesting
a conditional use for the real estate described on the exhibit
attached here and made a part hereof as Exhibit A ("Premises");
and
WHEREAS, the Petition requests a conditional use permitting
the Board to construct a public school on the Premises, which
is presently classified as "R S-3", Medium -High Density,
Single -Family Residential District; and
WHEREAS, a hearing on said Petition, as amended, was held
before the Zoning Board of Appeals in the manner and form as
prescribed by ordinance and statute; and
WHEREAS, as a result of said hearing, the taking of evidence
and viewing of exhibits, the Zoning Board of Appeals of the
City of McHenry did recommend to the City Council the granting
of the requested conditional use for use of the Premises as
a public school; and
WHEREAS, the City Council has considered the recommendation
as submitted by the Zoning Board of Appeals.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of McHenry, McHenry County, Illinois that the Zoning
Ordinance and the Zoning Maps of the City of McHenry, and such
ordinances and such map as amended, be and the same are hereby
amended, granting a conditional use to construct and operate a
public school on the Premises subject to the following conditions:
1. All pedestrian and vehicular/pedestrian accesses be
maintained by School District;
2. No vehicular traffic be allowed from Courtland Trail and
Cross Trail onto pedestrian accesses;
3. A landscape plan shall be filed by Petitioner as specified in
the Zoning Ordinance before approving the conditional use
permit, with special emphasis given to berming and screening
the proposed faculty parking area.
4. The loading and unloading of passengers from school buses
parked or located on City streets or on City street
right -of --ways adjoining the subject premises is prohibited.
5. Install a three (3) foot high chain link fence abutting
residential lots.
This ordinance shall be in full force and effect from and
after its passage as provided by law.
