ORDINANCE NO. 0-87-40
AN ORDINANCE PROHIBIT IG ERMnCHMENTS
WITHIN THE STATE OF ILLINOIS RIGHT OF
WAY ALONG FRONT ST. (ROUTE 31) STATE SECTION 112WRS-86
WHEREAS, the State of Illinois, acting by and through its
Department of Transportation, is desirous of improving Front
Street (Route 31) between High Street and South City Limits in the
City of McHenry; and
WHEREAS, said project• is being constructed in order to
facilitate the free flow of traffic and ensure safety to the
motoring public; and
WHEREAS, a portion of said project passes through the City of
McHenry;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Mc HENRY,
COUNTY OF MCHENRY, STATE OF ILLINOIS, as follows:
Section 1. That no person, firm, corporation or other entity
shall 1nT , place, mainatain or construct any structure that
encroaches upon the State of Illinois right-of-way on Front Street
(Route 31) within the limits of the City of McHenry.
Section 2. The City Clerk of the City of McHenry is hereby
authorized arxT—d irected to attach a copy of this Ordinance to the
agreement dated November 24, 1987, by and between the State of
Illinois and the City of McHenry relative to the improvement of
Front Street (Route 31).
Section :3. This Ordinance shall be in full force and effect
from and after its passage and approval according to law.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF Mc HENRY, COUNTY OF
Mc HENRY, STATE OF ILLINOIS, this 24th day of November, 1987.
