AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. That part of Linda Drive, to wit:
That part of Linda Drive, a roadway dedicated on the
plat of Unit No. 2 of Country Club Estates,
according to the plat thereof recorded July 15, 1958
as Document No. 340720 described as follows: All
that part of Linda Drive located South of the South
line of Skyway Drive as such line is extended
directly from East to West at the intersection of
Skyway Drive and Linda Drive, in McHenry County,
Illinois.
be and the same is hereby vacated reserving unto the City
of McHenry and its licensees and all public utilities now
maintaining public service utilities thereon a perpetual
unlimited easement therein and thereover.
SECTION 2. Any person, firm or corporation
violating_ any provision of this ordinance shall be fined
not less than Twenty Five Dollars ($25.00) nor more than
Five Hundred Dollars ($500.00) for each offense committed
on each day during, or on which, a violation occurs or
continues.
SECTION 3. Such street vacation is made upon the
express condition that title to the East one-half of said
vacated Linda Drive shall vest in the owner or owners of
the land abutting on the East side of said vacated Linda
Drive and that title to the Westerly one-half of said
vacated Linda Drive shall vest in the owner or owners of
the property abutting on the West side of the vacated
Linda Drive.
SECTION 4. All ordinances, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of such conflict.
SECTION 5. This ordinance shall be published in
pamphlet form by and under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 6. This ordinance shall be in full force
and effect from and after its passage, approval and
publication in pamphlet form, as provided by law.
