HomeMy WebLinkAboutOrdinances - O-87-416 - 03/04/1987 - GRANT CUP FOR ADDITION TO SHEPHERD OF THE HILLS CHORDINANCE NO.0-87-416 AMENDING THE ZONING ORDINANCE OF THE CITY OF MCHENRY, COUNTY OF MCHENRY, STATE OF ILLINOIS, AS FOLLOWS: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, ILLINOIS: SECTION 1: That a conditional use permit be and the same is hereby granted to the following described premiseSto permit the construction of an addition to the church building at the Northeast corner of the present building consisting of a lower level of 6,340 sq. ft. and a second level of 7,460 sq. ft. at the present floor level of the existing building, to wit: Part of the North Half of the Southeast Quarter of Section 35, Township 415 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the Northwest corner of said North Half of the Southeast Quarter of Section 35; thence Easterly along the North line of said Southeast Quarter, 33.0 feet to the East line of Elgin Road; thence Southerly along said East line a distance of 711.35 feet to a point for a place of beginning; thence Easterly at right angles to the last described course 607.40 feet, more or less, to the South line of said North Half of the Southeast Quarter of Section 35; thence Westerly along said South line 266 feet, more or less to the East line of a tract of land conveyed to the Western United Gas and Electric Company by Deed recorded in Book 180 of Deeds, page 61, thence Northerly along the East line of said tract 66 feet to the Northeast corner thereof; thence Westerly along the North line of said tract, being parallel with the South line of said North Half of the Southeast Quarter of Section 35, 124.0 feet to the East line of Elgin Road; thence Northerly along East line, 541.40 feet, more or less, to the place of beginning, in McHenry County, Illinois. SECTION 2: The City Council makes the following express findings: 1) That any adverse impact of type or volume of traffic flow associated with the granting of the conditional use has been minimized. 2) That adverse effects of noise, glare, odor, dust, waste disposal, blockage of air or light, if any, or other adverse environmental effects of a type or degree not characteristic of permitted uses in the single family residential zoning district, have been controlled. 3) That the proposed conditional use will not have undue deleterious effect on the environmental quality, pro- perty values or neighborhood character already existing in the area. 4) That the proposed conditional use will not generate dis- proportionate demand for new public service or community facilities in such a way as to place undue burdens upon existing development in the area. 5) That the proposed conditional use will not be detrimental to the safety or health of the employees, parishioners or visitors associated with the present use, nor the general public; in the vicinity. SECTION 3: That all Ordinances, parts thereof, in conflict herewith be, and the same are hereby repealed. SECTION 4: That this Ordinance shall be in effect from and after its passage as by :Law provided. PASSED this 4t.h day of March 11987.
