HomeMy WebLinkAboutOrdinances - O-86-411 - 12/03/1986 - AMEND ZONING RICHARD TAUBER 4611 W ELM STORDINANCE NO. 0-86-411 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF MCHENRY, ILLINOIS WHEREAS, a written Petition signed by RICHARD TAUBER, as the owner of 100% of the beneficial interest of HARRIS TRUST AND SAVINGS BANK OF CHICAGO, as Trustee under the provisions of a Trust Agreement dated January 10, 1969 and known as Trust Number 33565, has been filed with the City Clerk of the City of McHenry, Illinois, requesting the granting of an amendment of the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, concerning the following described premises: LOTS 7, 8 & 9 OF BLOCK 3 IN "LAKELAND SHORES UNIT NO. 3", BEING A SUBDIVISION OF PART OF THE NORTH HALF OF THE SOUTHWEST QUARTER OF SECTION 27, TOWNSHIP 45N, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, LYING SOUTH OF THE CENTERLINE OF STATE ROUTE 120, ACCORDING TO THE PLAT THEREOF RECORDED APRIL 25th, 1958 AS DOCUMENT NO. 337444 IN BOOK 13 OF PLATS, PAGE 55 AND AS AMENDED BY INSTRUMENT RECORDED MAY 9th, 1958, AS DOCUMENT NO. 338057 IN McHENRY COUNTY, ILLINOIS. and, WHEREAS, Petitioner, RICHARD TAUBER, is the Owner of 100% of the beneficial interest of the aforesaid trust which holds title to the above described premises, and, WHEREAS, said Owner is requesting an amendment of the City of McHenry Zoning Ordinance for the premises to its prior classification of "B-3" Commercial District to permit the operation of an automobile dealership on the premises, said operation requiring an amendment from the present classification of "B-2" Commercial -Recreation District, and, WHEREAS, a hearing was had before the City of McHenry Zoning Board of Appeals on October 16, 1986 and continued to November 20, 1986, at which time the Zoning Board of Appeals did take evidence and view exhibits presented thereat by the Petitioner, and, WHEREAS, on November 20, 1986, based on the evidence heard, the Zoning Board of Appeals found that there was no overriding reason for not granting the requested zoning amendment and by a vote of five for and none opposed did vote to reco*nmend said amendment for reclassification to the City Council, and, WHEREAS, based on the evidence heard, the Zoning Board of Appeals found, and the City Council concurs in that finding, that it would serve the interests of the City if an amendment of the Zoning Ordinance were granted. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, Illinois, as follows: That the Zoning Ordinance and the Zoning Maps of the City of McHenry, Illinois be and the same are hereby amended to reclassify the above and aforesaid property from "B-2" Commercial -Recreation District to "B-3" Commercial District, and; BE IT FURTHER ORDAINED that this Ordinance shall be in full force and effect from and after passage, approval and publication as provided by law.
