AN ORDINANCE AMENDING THE ZONING ORDINANCE OF
THE CITY OF McHENRY, ILLINOIS
WHEREAS, a Petition was filed with the City Clerk of McHenry,
Illinois by THOMAS C. ADAMS and JEAN C. ADAMS requesting reclassification
and amendment under the provisions of the City of McHenry Zoning Ordinance
as amended for the following described property, to -wit:
Part of the Northwest Quarter of Section 2, Township 44 North,
Range 8 East of the Third Principal Meridian, described as follows:
Commencing at the Northwest Corner of said Section 2; thence
East along the North line of the Northwest Quarter of said Section
2 for a distance of 817.54 feet to the Easterly right of way line of
State Route 31; thence South along said Easterly right of way line a
distance of 320.0 feet for a place of beginning; thence continuing
South along said Easterly right of way line a distance of 290.0 feet;
thence East at right angles to the last described line a distance of
400 feet; thence North parallel with said Easterly right of way line
a distance of 290.0 feet; thence West at right angles to the last
described course, a distance of 400.0 feet to the place of beginning,
in McHenry County, Illinois.
WHEREAS, THOMAS C. ADAMS and JEAN C. ADAMS are the owners of
said property and;
WHEREAS, the Petition requests that the property be reclassified
from "R-1" Single Family District to "B-3" Commercial District or to such other class-
ification, designation or variation as would permit the use of the property for auto-
mobile repair facilities and used car sales and;
WHEREAS, a hearing was held on said Petition before the City of McHenry
Zoning Board of Appeals on the 29th of November, 1984, and;
WHEREAS, the Zoning Board of Appeals did find that the standards for
variation, as found on Pages 58 and 59 of the Zoning Ordinance, have been met and;
WHEREAS, the Zoning Board of Appeals did recommend that a "B -1"
Classification be granted with a variation to permit use for automotive repair shop
and used car sales for said property.
WHEREAS, as a result of said hearing the Zoning Board of Appeals did
make its report and recommendation to the City Council;
NOW, THEREFORE, be it ordained by the City Council of the City of
McHenry, Illinois that the City of McHenry Zoning Ordinance and its maps be and
the same are hereby amended to reclassify the aforesaid property from "R-1" Residence
District to "B-1" Commercial District with a variation to permit use of the properties
for automotive repair facilities and used car sales.
BE IT FURTHER ORDAINED that this Ordinance shall be in full
force and effect from and after its passage and approval as provided by Law.
