HomeMy WebLinkAboutOrdinances - O-84-345 - 09/17/1984 - GRANT SPECIAL USE PIONEER CENTER ON WEST STORDINANCE NO. 0-84-345 AN ORDINANCE TO GRANT A SPECIAL USE PERMIT WHEREAS, a written Petition, signed on behalf of McHENRY STATE BANK, Trustee under `Crust No. 2109 and McHENRY COUNTY ASSOCIATION FOR THE; RETARDED, an Illinois Not -For -Profit Corporation, has been filed with the City Clerk of the City of McHenry, Illinois, requesting a Special Use Permit to allow McHENRY COUNTY ASSOCIATION FOR THE RETARDED to operate a "Residential Living Facility" for no more than six (6) individual developmentally disabled persons in addition to necessary supervisory personnel, so as to provide a home -style living environment through the development of individual and group programs, on the following described premises: Lots 21 and 22 in Block 2 of A.P. Freund Millstream Park Addition, Unit No. 1, a subdivision of part of the SouLhwesL. Quar•Ler of, Section 26, Township 45 North, Range 8 East of the Third Principal Meridian, according to Lhe PI(iL recorded April 19, 1949 as Document No. 219945 in Book 10 of Plats, page 111 in McHenry County, I11 inois; arnd WHEREAS, Petitioner, McHENRY STATE BANK, as Trustee under Trust No. 2109 is the owner of the above -described premises; and WHEREAS, Petitioner, McHENRY COUNTY ASSOCIATION FOR THE RETARDED has an option to lease the premises from said owner; and WHEREAS, NORMAN A. MacDONALD III►and KIYOE N. MacDONALD; of the State of California, are the sole beneficiaries of said McHENRY STATE BANK, Trust-- No. 2109; and WHEREAS, a hearing was held before the City of McHenry Zoning Board of Appeals on Thursday, the 6th day of September, 1984, at which time the said Zoning Board of Appeals did take evidence and view exhibits presented thereat by the Petitioner, and by a concurring vote of five (5) members recommended to the City Council of the City of McHenry the granting of the Special Use Permit aforesaid mentioned; and WHEREAS, based on the evidence heard, the Zoning Board of Appeals found and this City Council does hereby find that: (a) the special use will not cause substantial injury to the value of the other property in the neighborhood in which it is to be located; (b) the location and size of the special use, the nature and intensity of the operation involved in or conducted in connection with it, the size of the site in relation to it, and the location of the site with respect to streets giving access to it, shall be such that it will be in harmony with the appropriate and orderly development of the district in which it is to be located; (c) the location, nature and height of buildings, walls and fences, and the nature and extent of the landscaping on the site shall be such that the use will not hinder or discourage the appropriate development and use of adjacent land and buildings, or will not impair the value thereof; (d) parking areas shall be of adequate size' for the particular use, properly located, and suitably screened from adjoining residential uses, and the entrance and exit drives shall be laid out so as to prevent traffic hazards and nuisances. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, Illinois, as follows: That a Special Use Permit is hereby granted to allow McHENRY COUNTY ASSOCIATION FOR THE RETARDED to operate a "Residential Living Facility" for no more than six (6) individual 2 developmentally disabled persons in addition to necessary supervisory personnel, so as to provide a home -style living environment through the development of individual and group programs, on the following described premises: Lots 21 and 22 in Block 2 of A.P. Freund Millstream Park Addition, Unit No. 1, a subdivision of part of the Southwest Quarter of Section 26, Township 45 North, Range S East of the Third Principal Meridian, according to the Plat recorded April 19, 1949 as Document No. 219945 in Book 10 of Plats, page Ill in McHenry County, Illinois; BE IT FURTHER ORDAINED that this ordinance shall be in full force and effect from and after passage, approval and publication as provided by law.
