HomeMy WebLinkAboutOrdinances - O-84-338 - 06/11/1984 - PD PERSONNEL MATTERSORDINANCE NO.0-84-338 AN ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1. The Rules and Regulations for the Police Department, City of McHenry, Illinois, be and the same are hereby amended by adding the following provision to exist- ing Rule of Conduct Number 19, which additional paragraph has heretofore been adopted by the Chief of Police, City of McHenry Police Department, and recommended by him to the Mayor and City Council for approval: "Police Department personnel shall immediately submit to a test by an alcohol breath testing instrument, or blood test, while on duty, if ordered to do so by a superior or commanding officer. Refusal to submit to such testing shall be deemed to constitute a refusal to obey a lawful order of a superior officer. Police Department personnel refusing to obey such an order shall be immediately relieved of duties and a full written report of the incident shall be made to the Chief of Police for further review and action. SECTION 2. All ordinances, or parts thereof, in conflict with the terms and provisions hereof, be and the same are hereby, repealed to the extent of such conflict. SECTION 3. This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 4. This ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form, as provided by law. PASSED this llthday of June , 1984. MAYOR ATTEST: Formo . mr. -2- AMENDMENT OF CITY OF McHENRY, ILLINOIS POLICE DEPARTMENT GENERAL RULES AND REGULATIONS The Rules and Regulations governing the City of McHenry Police Department personnel be and the same are hereby amended by adding the following additional paragraph to existing Rule of Conduct Number 19: "Police Department personnel shall immediately submit to a test by an alcohol breath testing instrument, or blood test, while on duty, if ordered to do so by a superior or commanding officer. Refusal to submit to such testing shall be deemed to constitute a refusal to obey a lawful order of a superior officer. Any and all Rules and Regulations, or parts thereof of the City of McHenry Police Department in conflict with the terms and provisions of the aforesaid Amendment be and the same are hereby repealed to the extent of such conflict. The foregoing Amendment shall become effective immediately upon its approval by the Mayor and City Council of the City of McHenry, Illinois.
