AN ORDINANCE TO AMEND THE SPECIAL USE AS SET FORTH IN
ORDINANCE NO. 0-76-82-75 OF
THE CITY OF McHENRY, ILLINOIS
WHEREAS, a written Petition, signed by BERTRAM L. MINER and
LLOYD BERHOFF, has been filed with the City Clerk of the City of McHenry, Illinois
requesting a Special Use Permit to allow the construction of a one-story, 11,000 square
foot addition to increase the number of beds from the original 312, to 362 in the skilled
care nursing facility on the following described premises:
and
PARCEL 1: Lot "B" in Boone Valley Plat,No. 6, a Subdivision of
part of the Northwest Quarter of Section 34 and part of the North-
east Quarter of Section 33, Township 45 North, Range 8 East of
Third Principal Meridian, and recorded June 10, 1971 as Document
No. 544371, in McHenry County, Illinois.
PARCEL 2: Lot "C" in Boone Valley Plat No. 6, a Subdivision of
part of the Northwest Quarter of Section 34 and part of the North-
east Quarter of Section 33, Township 45 North, Range 8 East of the
Third Principal Meridian, and recorded June 10, 1971 as Document
No. 544371 (except that part thereof described as follows: Commencing
at a point on the Southwesterly line of said Lot "C" South 37 degrees
53 minutes 07 seconds East 200 feet from the most Westerly corner
of said lot; thence continuing South 37 degrees 53 minutes 07 seconds
East 100 feet; thence North 52 degrees 06 minutes 53 seconds East
100 feet; thence North 37 degrees 53 minutes 07 seconds West 100
feet; thence South 52 degrees 06 minutes 53 seconds West 100 feet
to the place of beginning), in McHenry County, Illinois.
WHEREAS, Petitioners, LaSALLE NATIONAL BANK, as Trustee
under Trust No. 104444, and BERTRAM L. MINER and LLOYD BERHOFF, as Beneficiaries
of said Trust, are the owners of the above -described premises, and
WHEREAS, Petitioners are requesting that the Special Use Permit as set forth
in Ordinance No. 0-76-82-75, passed and approved April 26, 1976, be amended to allow the
construction of an 11,000 square foot addition to the present structure and an increase of bed
capacity by fif ty to a total of 362 beds, and;
WHEREAS, a hearing was held before the City of McHenry Zoning Board of
Appeals on Thursday, the 8th day of March, 1984, at which time the said Zoning Board of
Appeals did take evidence and view exhibits presented thereat by the Petitioners, and;
WHEREAS, based on the evidence heard, the Zoning Board of Appeals found:
(a) the special use will not cause substantial injury to the value of other pro-
perty in the neighborhood in which it is to be located;
(b) the location and size of the special use, the nature and intensity of the
operation involved in or conducted in connection with it, the size of the
site in relation to it, and the location of the site with respect to streets
giving access to it, shall be such that it will be in harmony with the
appropriate and orderly development of the district in which it is to be
located;
(c) the location, nature and height of buildings, walls and fences, and the
nature and extent of the landscaping on the site shall be such that the use
will not hinder or discourage the appropriate development and use of
adjacent land and buildings, or will not impair the value thereof;
(d) parking areas shall be of adequate size for the particular use, properly
located, and suitably screened from adjoining residential uses, and the
entrance and exit drives shall be laid out so as to prevent traffic hazards
and nuisances, and;
WHEREAS, based on the evidence heard, the Zoning Board of Appeals found that
the Petitioners are required to provide a minimum of 120 parking spaces so as to comply with
the City of McHenry Zoning Ordinance and that the berm located at the corner of Oakwood and
Royal Drives should be left in its present condition.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry,
Illinois, as follows: that the special use as set forth in Ordinance 0-76-82-75 approved April 26,
1976, be amended to allow the construction of an 11,000 square foot, one-story addition to
accommodate an additional 50 beds for the skilled care nursing facility now known as Royal
Terrace Nursing Home, being legally described above, and;
BE IT FURTHER ORDAINED that the berm located at the corner of Oakwood and
Royal Drives shall be left in its present condition and the Royal Terrace Nursing Home provide a
minimum of 120 parking spaces, and
BE IT FURTHER ORDAINED that this ordinance shall be in full force and effect
from and after passage, approval and publication as provided by law.
