COUNTY OF McHENRY ) CITY OF McHENRY ) AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS 0 ��-7 pc) �f WHEREAS, HAROLD J. PAUL and JOSEPHINE E. PAUL of the City of McHenry, McHenry County, Illinois, filed, in addition to their petition for Annexation, a petition for re-classification of the premises hereinafter described to "B-3" Commercial Use District under the Zoning Ordinance of the City of McHenry,, Illinois, and WHEREAS, notice, as required by said Zoning Ordinance, was published fixing the date of the hearing on said petition, and the necessary notices were given to adjoining and abutting property owners; and WHEREAS, a hearing was had on said petition on the 20th day of October, 1983, at the hour of 7:30 P.M.; and WHEREAS, as a result of said hearing, the Zoning Board of Appeals of the City of McHenry recommended to the City of McHenry that, among other things, the request for a re-classification. to "B-3" Commercial Use be granted, including a non -conforming use as and for the petitioner's residence located on said premises herein- after to be described. NOW, THEREFORE, BE IT ORDAINED by the MAYOR and CITY COUNCIL of the City of McHenry, County of McHenry, and State of Illinois, as follows: SECTION 1. That the Zoning Ordinance of the City of McHenry, Illinois, and the zoning map of the City of McHenry, Illinois, be and the same are hereby amended as follows: (a) That the following described property shall be a part of the "B-3" Commercial Use District, to -wit: Of that part of the Southwest Quarter of Section 2, Township 44 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning on the West line of said Section 2 at a point 275.75 feet South of the Northwest corner of said Southwest Quarter and running thence Easterly on a line forming an angle of 90 degrees 35 minutes to the left with a prolongation of the last described line, for a distance of 722.35 feet to the Westerly boundary of the highway known as State Route 31; thence continuing along the last described line extended 91.76 feet to the Easterly boundary line of said highway; thence Southwesterly on a line forming an angle of 78 degrees 11 minutes 51 seconds as measured counter clockwise from the last described line 30.66 feet to a point; thence Southwesterly on a line forming an angle of 172 degrees 33 minutes 40 seconds as measured counter clockwise from the last described line, 95.3 feet; thence Southwesterly on a line forming an angle of 184 degrees 53 minutes 55 seconds as measured counter clockwise from the last described line 4.45 feet; thence Westerly on a line forming an angle of 104 degrees 21 minutes 35 seconds as measured counter clockwise from the last described line 84.34 feet to the Westerly boundary line of said highway; thence continuing on the last described line extended Westerly 691.95 feet in a straight line to a point on the West line of said Section 124.53 feet South from the aforesaid place of beginning; thence North 124.53 feet to the place of beginning, in Nunda Township, McHenry County, Illinois. (b) That a non -conforming use shall be provided to permit the petitioners the continued use of their residence located upon the premises described in Section 1. (a), above, in accordance with the Zoning Ordinance of the City of McHenry, Illinois. SECTION 2. That all ordinances or parts thereof in conflict herewith be and the same are hereby repealed. SECTION 3. That this ordinance shall be in full force and effect from and after its passage and approval according to law.
