RESOLUTION OF THE CITY OF McHENRY
A Resolution Authorizing the City of McHenry
to Participate in the Illinois Property Tax Appeal
Board Hearings, and for Professional Services Pursuant Thereto
WHEREAS, the City of McHenry ("City") is a unit of government located within
McHenry County, Illinois; and
WHEREAS, the Illinois Revenue Code, 35 ILCS 200/9-160, mandates that the
Township Assessor shall assess all properties within the Township as of January 1 of
that assessment year; and
WHEREAS, all taxpayers have the opportunity to protest said assessments by
filing objections with the McHenry County Board of Review ("Board of Review")
pursuant to 35 ILCS 200/16-55; and
WHEREAS, all taxpayers and taxing districts have the right to appeal any
decision of the Board of Review to the Illinois Property Tax Appeal Board ("IPTAB");
and
WHEREAS, in the event a tax objection is adjudicated by the Board of Review
and said tax objection is appealed to the IPTAB, the affected taxing districts are not
a party to the appeal, but may intervene pursuant to 35 ILCS 200/16-175; and
WHEREAS, under the rules promulgated by the IPTAB, Section 1910.60, any
petition to intervene which is filed by a taxing body must include " a resolution of the
governing board of the taxing body authorizing its legal representative to file the
motion to intervene"; and
WHEREAS, it is in the best interest of City and other affected taxing bodies to
intervene, participate and otherwise engage in the tax objection procedure in order to
ensure accurate, uniform and equitable assessments for the benefit of all property
owners; and

WHEREAS, the City has determined that in order to promote accurate, uniform
and equitable assessments, it would be beneficial to authorize the City Attorney (or,
in the event of a conflict other competent counsel) to retain a certified MAI appraiser,
licensed in the State of Illinois, to assist the City in terms of representing the City, and
perhaps, all affected taxing districts before the IPTAB; and
NOW, THEREFORE, BE IT RESOLVED BY CITY COUNCIL OF McHENRY,
McHENRY COUNTY, ILLINOIS, AS FOLLOWS:
1. The City Attorney (or, in the event of a conflict, retain other competent counsel)
is authorized to intervene on behalf of the City in IPTAB cases with docket
numbers of 01-01262.001 and 01-01263.001 and retain an appraiser, certified
in the State of Illinois, to participate in the IPTAB hearings, as the City Attorney
deems necessary.
2. The City Attorney (or, in the event of a conflict, retain other competent counsel)
is authorized to intervene on behalf of the City in IPTAB cases with docket
numbers of 01 -01 279-C-3.001,01-01279-C-3.002 and 01-01 279-C-3.003and
retain an appraiser, certified in the State of Illinois, to participate in the IPTAB
hearings, as the City Attorney deems necessary.
2. In order to offset the short-term expenses incurred by this resolution, the City
May pursue intergovernmental agreements with other taxing bodies throughout
the McHenry County.
BE IT FURTHER RESOLVED that the Clerk spread the above resolutions upon the
minutes of the meeting said resolutions were passed.
