CITY OF MCNENRY ORDINANCE # 0-82-291
CITY OF McHENRY, ILLINOIS
WHEREAS, HANK BUCH & SON HEATING AND AIR CONDITIONING,
INC., an Illinois Corporation filed a Petition with the City of McHenry Zoning
Board of Appeals requesting amendment of the City of McHenry Zoning Ordinance
for the following real estate, to -wit:
Lot 5, (excepting and reserving therefrom the Northeasterly
11 feet in width thereof) and the Southeasterly Half of Lot 6,
(excepting and reserving the Northeasterly 11 feet in width
thereof), in Block 20 in the Original Plat of McHenry, lying
on the Westerly side of Fox River, a Subdivision of part of
Section 26, Township 45 North, Range 8 East of the Third
Principal Meridian, according to the Plat thereof recorded
July 6, 1840 in Book B of Deeds, page 160, in McHenry County,
Illinois.
Commonly known as 1309 North Park Street, McHenry, Illinois 60050, and
WHEREAS, said Petition requested as one alternative a variation to
permit the construction of a 30' x 30' addition to the existing garage and to permit
said building to be used for a sheetmetal shop and heating and air conditioning
business, and
WHEREAS, a hearing on said Petition was held before the City of
McHenry Zoning Board of Appeals, and
WHEREAS, as a result of said hearing the Zoning Board did find that
the Petitioner met the requirements for a variation as follows:
A. The particular physical surroundings, shapes, or topographical con-
dition of the specific property involved would result in a particular
hardship upon the owner, as distinguished from a mere inconvenience,
if the strict letter of the regulations were carried out;
B. The conditions upon which the Petition for a variation is based are
unique and would not be applicable, generally, to other property
within the same zoning classification;
C. The purpose of the variation is not based exclusively upon a desire
to make more money out of the property;
D. The alleged difficulty or hardship has not been created by any person
presently having an interest in the property;
E. The granting of the variation will not be materially detrimental
to the public welfare or injurious to other property or improvements
in the neighborhood in which the property is located; and
F. The proposed variation will not impair an adequate supply of light
and air to adjacent property, or substantially increase the congestion
in the public streets, or increase the danger of fire, or endanger
the public safety, or substantially diminish or impair property values
within the neighborhood.
WHEREAS, the Zoning Board of Appeals did recommend to the City
Council the granting of a variation of the B-1 Classification for said real estate
as follows:
A. To permit the use of the residential building on the property for
uses consistent with the B-1 Zoning classification.
B. To permit construction of a 30' x 30' addition to the existing garage
thereon and to use said buildings for a tin shop and heating and
air conditioning contracting business.
WHEREAS, the Mayor and City Council of the City of McHenry, Illinois
have considered the recommendation of the Zoning Board of Appeals,
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Counsel
of the City of McHenry, Illinois that a Zoning variation be and it is hereby granted
for the real estate described herein as follows:
A. To permit the use of the residential building on the property for
uses consistent with the B-1 Zoning classification.
B. To permit construction of a 30' x 30' addition to the existing garage
thereon and to use said buildings for a tin shop and heating and
air conditioning contracting business.
This Ordinance shall be in full force and effect from and after its passage
as by law provides.

Dear Don,
The Council wanted it understood that since the variation that
was granted for the above captioned property allows for two main
buildings on one lot, the owner should be aware that there must be
a separate water meter for each building and there will be a sepa-
rate sewer charge for each building.
We've had occasions in the past where property has been sold
off or divided and problems have surfaced.
