The Operational Manual for the McHenry Police Department, having heretofore been approved and adopted by the Chief of Police of the City of McHenry, Illinois and recommended by him to the Mayor and City Council for adoption by them, a copy of which is attached hereto and made a part hereof, be and the same are approved and adopted as and for the Operational Manual for, and rules of conduct of, the McHenry Police Department. SECTION 2. All ordinances, or parts thereof, in conflict with the terms and provisions hereof, be and the same are hereby repealed to the extent of such conflict. SECTION 3. This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 4. This ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form, as provided by law. PASSED this 17th day of May, 1982. B. When the national anthem is played. C. Inside, when personnel are covered (hat on), and the national colors pass and/or when the national anthem is played. Personnel shall face the colors when saluting, and if the colors are not present, face;the music of the national, anthem. Police personnel shall regard as a general rule the condition of his uniform; for example: all leather highly polished, all brass shined, the uniform clean and neatly pressed, all buttons buttoned at all times. (2) RULES OF CONDUCT Purpose The McHenryPolice Department in -its desire to project an unsullied image must regulate the conduct of its personnel by rules and regulations. These rules and regulations of conduct will "serve a two -fold purpose: (1), To project an image of high moral standards, and (2), To place the personnel of the McHenry Police Department in the highest degree of professionalism in the field of law enforcement. 1. Rules and regulations,of conduct of the McHenry Police Department shall be issued by the Chief of Police. 2. Police personnel -shall carry out the orders of a superior officer. �3. The act of carrying out the order of a superior officer by police personnel shall be deemed the act of the superior officer issuing said order. 4. Police personnel shall not countermand any order given or issued by a superior -officer except in cased of emergency. When such action is taken, the police officer countermanding these orders -shall submit" a written report to his superior officer giving the reasons for such action. This report shall be submitted .at the earliest•'possible time. 3. If , in the opinion of the police officer, an order is unjust or . improper, the police officer shall carry out the order then submit to his superior officer in writing his reasons for the order being improper. 6'. No commanding officer or superior officer shall issue an order or command which is contrary to any rules of conduct, policy of proce- dure, or which will be subversive to, or delete from, the image and professionalism of the Department. (3) 7. Any supervisory or commsnding officer, observing an infraction of the rules of conduct, policies and procedures, or any action detrimental to the McHenry Police Department shall immediately take appropriate action and submit a report in writing to his next superior officer explaining the action taken. 8. Police personnel shall 7report for'duty at the proper time speci- fied; this shall be no later than fifteen minutes prior to his tour of duty. 9. " .--,=. When -two or -more police officers of equal rank are on patrol or duty at the same time, the officer senior in years of rank will take command -unless otherwise specified by a superior officer. 10. All police personnel are subject to duty call twenty-four hours of the day, every day of the year. Police personnel shall report immediately to duty when called any hour of the day or night and any day of the year in any emergency whether on or off duty on notice that their service is needed. 11 When an officer is called to such duty and fails to report because of sickness, the officer-shall.submit to his superior officer, a written explanation signed by an attending physician prior to re- turning to duty. 12. Police personnel who are unable to report for regular duty be- cause of sickness or injury shall.notify their commanding or. next superior officer at least one hour prior to beginning their tour of duty. It shall be the responsibility of the shift commanders to check All reports of such sickness or injury, by contacting Officer personally or by telephone. 12 a. Police personnel after reporting in sick will not -leave the City without authorization from the Lieutenant of Police. In the absence of the Lieutenant of Police the shift commander on duty at that specific time will give'such authorization. (4) 16 13. After having been sick or injured for three or more days, police personnel shall submit written explanation of their illness or injury signed by an attending physician prior to reporting for their next tour of duty. 14 Police personnel shall not leave their district of patrol except in an emergency situation. 15. Police personnel who are ordered to appear in court on a civil matter shall notify their next superior officer in writing. It shall be forwarded to the Chief of -Police through the Chain of Command. 16. Police personnel who become personally involved in legal matters either criminal or civil shall, notify their next superior officer in writing to be forwarded through the Chain of Command to the Chief of Police. 17. Police personnel shall appear in court on their court date. Police personnel wtio are unable to appear due to sickness or injury, shall notify their next superior officer who in turn shall notify the courts. 18. Police personnel shall not enter any disreputable place'or. business establishment selling intoxicating beverages while -in uniform except in performance of his duties. 19. Police personnel shall not use any intoxicating beverage or in- dulge in any improper practice while on duty, in uniform, or prior to.his reporting for duty so as to render him unfit for duty � or to bring suspic'on upon the Department. 20. The use of narcotic'�or dangerous drugs, exceptiby orders of a physician, is -strictly forbidden, but when prescribed,officer shall immediately notify shift commander and/oz Chief of Police. (5) 21. Police personnel shall not solicit food, merchandise, or any goods without proper payment thereof. 22. Police personnel shall not solicit any money or other compen- sations for damages incurred while on duty except by permission from the Chief of Police. 23. Police personnel shall not engage in any activity, business, or affiliate with any group or organization which will be detrimental to, reflect unfavorably upon, or interfere with his duties as a member.of the McHenry Police Department. 24. Police personnel shall not violate the laws of any municipality or any state of the United States. 25. Police personnel shall not discuss any matter pertaining to the McHenry Police Department in any manner that may be detrimental to or bring discredit upon the McHenry Police Department. 26. Police personnel shall not give any information in any form to any person when such information would be detrimental to the working efficiency of the Department. 27. Police personnel shall refrain from harsh, coarse, insolent, abusive or abscene language, or horseplay while within the Department or through normal tour of duty, or at any time while in uniform. 28.' Police personnel shall not submit any report whatsoever that is false or�shall;tend to be misleading. 29. Police personnel •shall not become encumbered by incurring financial* debts that he cannot meet. 30. Police personnel shall meet all financial -responsibilities in- curred. _ (6) 31. Police personnel,shAll refrain from immoral conduct or any conduct unbecoming an officer. 32. Police personnel shall nver neglect his duty. 33. Police personnel shall not sleep on duty. 34. Police personnel shall not disobey orders. 35. Police personnel shall not be insubordinate. 36. Police personnel shall never use any weapon illegally. 37. Police personnel who feel they have a grievance because of their duty, assignment, treatment by a -superior officer, or for any reason pertaining to their status and/or service in the McHenry Police Department may make a written grievance complaint - and submit this report to their superior officer thru the Chain of Command to the Chief of Police. This report shall further contain the recommendation of the superior officer forwarding such report. 38. Police personnel shall use only the force necessary to effect any. arrest. 39. Police personnel shall not humiliate, embarrass or otherwise profanely treat any person arrested for any offense. 40. Police personnel shall return all equipment initially furnished by the McHenry Police Department upon their separation from service. This shall include all Leaves of Absence. ' 41. All police personnel.upon receiving a diciplinary suspension for more than three days shall surrender to his shift cormnander his weapon, nightstick, star, shield, and identification card. This equipment will be immediately forwarded to the Chief of Police. (7) 42. Police personnel shall preform the statutory obligations established for the position of a McHenry Policeman 43. Police personnel shall maintain P working knowledge of local, stAte and federal statutes. 44 Police personnel shall aid the prosecutor when required in preparation of cases and when required present evidence to the court. 45. Police personnel shall take appropriate action in all cases where it is in the interest of the public welfare and safety. 46. Police personnel shall be on the alert for potentially hazardous situations or problem areas and report same to the Shift commander. ' 47. Police personnel shall render assistance to distressed citizens and provide guidance and correction when requested. 48. Police personnel shall maintain a physical appearance that is -commensurate-with-•the-- favorable image-ef-� the, McHenry_ Police_~ Department. 49. Police personnel shall perform duties required by specific assignment. 50. Police personnel shall enforce all.laws ( City, State and Federal). 51. Police personnel shall not engage in or take an active part in, any political action or campaign, nor use his/her official authority or influence in any manner, that may be construed as to be coersive or to reflect an unfavorable image upon the McHenry Police Department. This order shall mean but not be limited to the followings A. Actively seeking/soliciting signatures for elective position - petitions. B. Distributing, wearing or toting of any political signs, badges, literature or other political paraphenalia. C. Seek or accept any position, as a volunteer or otherwise, at any voting poll. This rule shall not be construed as to prohibiting or preventing Police personnel from membership in any political club or organization, from attending any political meeting or from otherwise engaging freedom from all interference in casting his/her vote or privately expressing his opinion or views in all aspects of the political area. UNIFORMS The City of McHenry, by City Ordinance, will furnish a set sum of monies to each sworn individual Police Officer to purchase his uniform and accessories. The amount of money will be at the discretion of the City Council and paid annually, semi-annually, or at the dis- cretion of the Council. Such uniforms will be for the purpose of the indentical and distinctive dress to identify police personnel as members of the McHenry Police Department, to set them apart from any other police agency, to create a favorable public image and to also maintain a high morale amoung our members. Any uniform purchased by members of this Department shall adhere strictly to the uniform specifications submitted to and approved by the City Council of McHenry. The complete uniform of the day and appropriate accessories shall be worn at all times. No part of the uniform or any accessories shall be worn at all times. No part of the uniform or any accessories shall be worn off duty. Uniforms shall be kept clean and neatly pressed at all times. Uniforms shall be fitted and tailored, and ' it shall be the responsibility of the individual Officer to see that this end is accomplished. No alterations to either the Uniform or accessories will be permitted without express permission of Chief of Police. Changeover of winter and summer uniforms of the day codes shall be made at the discretion -of the Commanding Officer of the individual shift in compliance with the Chief of Police, keeping in mind that all men on that particular shift shall wear the same uniform. On the twentieth of June,, all men on all shifts shall wear summer uniforms. Discretionary dates for the Shift Commanders in compliance with the Chief of Police shall be the first day of September, either winter uniforms or summer uniforms will be applicables and the first day of May, either winter uniforms or summer uniforms will be applicable. .Uniform of the day shall be designated as follows; Class A - Full dress winter uniform Winter Hat Black Socks Long Sleeve Shirt(winter) Black Oxfords Gray Tie Tie Clip Jacket (winter) Slacks (winter) Black Leather Garrison Belt (9i CLASS B - WINTER UNIFORM Winter Hat Long Sleeve Shirt (winter) Slacks (winter) Gray Tie Tie Clip Black Socks Black Oxfords Black Leather Garrison Belt CLASS C - FULL SUMMER UNIFORM Summer Hat Long Sleeve Shirt (winter) Gray Tie Tie Clip Slacks (summer) Black Socks Black Oxfords Black Leather Garrison Belt CLASS D - SUMMER UNIFORM Summer Hat Short Sleeve Shirt (summer) Slacks (summer) No Tie Black Socks Black Oxfords Black Leather Garrison Belt WEARING OF UNIFORM ACCESSORIES: SAM BROWN BELT: The Sam Brown Belt shall be worn in such a manner that the buckle is centered on an imaginary line from shirt buttons thru the belt buckle. BELT KEEPERS: The four (4) prescribed belt keepers shall be worn at all times with the Sam Brown Belt. Keepers shall be placed so as to align with the outer creases of the trousers both front and rear. Outer keeper flap will be on the lower edge of belt. HOLSTER: The prescribed holster shall be worn on the right side of the Officer and centered on the seam of the right trouser leg. HAND CUFF CASE: The prescribed hand cuff case shall be worn on the left side of the Officer on the Sam Brown Belt and centered on the seam of the left trouser leg. BATON RING: The prescribed baton ring shall be worn on the right -side of the Officer on the Sam Brown Belt immediately to the rear of the hand cuff case. (10) SHOES (OXFORDS): . The uniform oxfords shall be black with plain toes and no less than five nor more than six eyelets and laced right over left. The shoes shall not be scotch or pebble grain nor shall they have crepe souls. Either Cordovan or Corfam leathers are acceptable. At no time shall any type boot be worn. OVERSHOES: Overshoes when worn, shall be fully buckled or zipped and shall be black in color. GLOVES: Only black leather gloves shall be worn with the uniform. BADGES: The issued badge of the McHenry Police Department shall be worn with the uniform at all times. It shall be worn on the outer -most piece of the uniform; for example; If the blouse is worn, the badge shall be worn on the blouse, if the reefer is worn, the badge shall be worn on the reefer. NAME PLATE: The issued name plate shall be worn above the right front pocket of the shirt or blouse and in such a manner that the lower edge of the plate shall rest on and run parallel with the upper -most edge of the shirt or blouse pocket flap and shall be centered within the inner and outer seams of the right pocket. TIE CLASP: The prescribed tie clasp shall be worn in such a manner as to be directly parallel with an imaginary line drawn between the upper most seams of the breast pockets. The above items shall be worn with brass hardware such as snaps, buckles, etc, for the Rank of Sergeant and above and nickel hardware for the Patrolmen. All leather accessories shall be polished corfam. WEARING OF THE UNIFORM: HAT: T he prescribed hat shall be worn squared on the Officers head; it shall not. be tilted right or left and never forward so as to protrude below the Officer's eyebrows. The hat cord worn by the Rank of Sergeant and above shall be Gold; the bat cord worn by Patrolmen shall be silver. The issued hat shield shall be worn with the hat at all times. FUR CAP: The fur cap may be substituted for the winter hat in extremely cold weather. The cap shall be worn squared on the Officer's head and never below the Officer's eyebrows. The cap shall be worn complete with a proper shield. Hat shall be worn. at all times when the Officer.is out of the car. WINTER SHIRT: The winter shirt shall be worn complete with shoulder patches and when applicable, with appropriate insignia of rank. The winter shirt shall be worn completely buttoned. No item shall be stuffed in the shirt pockets that shall produce a bulging appearance. No items such as pens, pencils, and etc., shall be carried in the shirt pocket so as to protrude above the flap. SUMMER SHIRT: The summer shirt shall be worn complete with shoulder patches and when applicable, with appropriate insignia of rank. The summer shirt shall 'be worn completely buttoned with the exception of the neck button - the collar being left open. No items shall be stuffed in the shirt pockets that shall produce a bulging appearance. No items such as pens, pencils and etc., shall be carried in the shirt pocket so as to protrude above the flap. Regulation white hi neck tee shirt shall be worn at all times with the summer shirt. TROUSERS: The prescribed trousers only shall be worn as part of the uniform. WINTER JACKET: Only the prescribed winter jacket complete with shoulder patches shall be worn. TIE: The prescribed gray clip on or four-in-hand tie shall always be worn except with the summer uniform. SOCKS: Socks, black in color with no design, shall be worn with the uniform. Police Officers will pay particular attention to their personal hygiene, at all times while wearing the uniform of the McHenry Police Department. Hair will be neatly trimmed and combed. Side burns will never be worn below an imaginary line drawn horizontally across the middle of the ear. Mustaches, IF WORN, shall not protrude further than the right or left edge of the.mouth and shall be neatly trimmed. Fingernails shall be clean and trimmed. CHIEF'S WINTER SHIRT: One gold eagle shall be worn on each collar side, with the head of the! beak to the front. The eagle shall be centered between the top and bottom edge of the collar and the front wing tip shall be half inch from the front edge of the collar. (12) SUMMER SHIRT: One gold eagle shall be worn on each shirt collar side in a horizontal position. The eagle shall be centered between the inner and outer edge of the collar and the feet of the eagle shall be half inch above the lower edge of the collar. LIEUTENANTS WINTER SHIRT: One gold bar shall be worn on each collar side in such a manner.that the long front edge of the bar shall be half inch from the lower edge of the collar and centered between the top and bottom edge of the collar. SUMMER SHIRT: One gold bar shall be worn in a vertical position on each collar side in such a manner that a line bisecting the center of the bar would bisect the center of the lower collar edge which is in a horizontal line position. SERGEANT'S WINTER SHIRT One gold three bar chevron shall be worn on each collar side in such a manner that the left edge of the chevron shall run parallel with the lower collar and shall be half inch from the lower collar edge. SERGEANT'S SUMMER SHIRT: One gold three bar chevron shall be worn on each collar side with the top of the chevron pointing upward. The lower points of the chevron shall be half inch above the lower collar edge, a line connecting the lower chevron points shall run par- allel.with the lower collar edge. (13) UNIFORMS: COURT APPEARANCE: Sworn personnel of the McHenry Police Department when appearing in Court, shall appear appropriately attired. This shall include Branch III or I, all Hearings, Motions and Trials. The appropriate attire shall be described as follows: 1. Sport Coat/Suit Dress Shirt Tie Slacks Oxfords 2. Uniform of the day Officers Will note that blue jeans, "T" shirts, sweaters, windbreakers etc. are not acceptable. (13a) INSPECTIONS I. PURPOSE The purpose of inspections within the McHenry Police Department is to present and maintain the highest professional image obtain- able by the Members of the McHenry Police Department. II. POLICY It shall be the policy of the McHenry Police Department to conduct personnel, building and equipment inspections. CATAGORIES 1. Personnel of the McHenry Police Department shall be semi- formally inspected each day when reporting for duty. This inspection shall be carried out by the senior Sergeant un- less otherwise authorized by the Chief of Police. 2. All uniform personnel inspections include evaluations of the following: ' A. Appearance B. Uniform C. Leather D. Weapon E. Hardware (brass or nickel) F. Shoes 3. When reporting for duty, all uniform personnel shall have the following: A. Valid Illinois Driver's License B. Watch C. Notebook D. Pen E. Flashlight F. Handcuffs: G. Night Stick (14) Lieutenants of the McHenry Police Department. Purpose This order defines the authority and responsibilities of the Lieutenant.of Police. It is the policy of the McHenry Police Department to determine responsibility therby establishing accountab}ali.ty directed toward maximum efficie ;my throughout the department. Authority Lieutenant of Police shall: I• Receive directions from and be responsible directly to the Chief of Police. Exercise direct authority over all field operational person— - nel, ..facilities and activities.,_ :__� j III. Assume command of field operations, facilities and personnel when so ordered by the Chief of Police IV. Relieve from duty status any subordinate found in a condition detrimental to the McHenry Police Department. 1. Upon taking such action a written report will be directed to the Chief of Police containing recommendations for disciplinary action together with any other reports per— taining to the incident. 2, All acts and decisions of the Lieutenant are subject to review by the Chief of Police General Responsibilities Lieutenant of Police shall: I. Serve as staff to the Chief of Police, assisting in the formulation of field operation objectives, de— velopment of plans to accomplish objectives -and coordination of all field operations. II. Be responsible to the Chief of Police for effective command. -and supervision of field operational personnel, facilities and activities, insuring compliance'with existing policy, rules, directives and orders of the Chief of Police and all intermediate commands. III. Exercise police power and have supervisory authority commensurate with rank. The accountability for the supervision of all subordinates, facilities and oper— ations rest with the Lieutenant of Police. (15) Lieutenants of thel4cHenry Police Department Specific Responsibilities Lieutenant of Police sVall: I. Subject to the approval of the Chief of Police, establish, revise as needed and implement field operation programs. II. Direct and coordinate activities of subordinates assigned to specific shifts or divisions. III. Be responsible for the operation and supervision of personnel, facilities and equipment of specific divisions or shifts within the McHenry Police Department. Responsibility also includes the proper custodial maintenance of sections used, including but not limited to proper care of prisoners including any med— ical attention needed by prisoners. IV. Promote the development -of subordinates Knowledge,,- ability and confidence to make decisions that will -enhance the -effect— iveness, efficiency and reputation of the shift, division and the McHenry Police Department.! V. Record infractions of all rules, regulations, policies and procedures. VI. Supervise the Activities of all immediate -subordinates to insurelthey are exercising supervisory authority in accordance with existing policies and orders in the most effective and efficient manner. VI. Assist supervisors in resolving local field operations prob— lems by advise and counsel and by coordinating the efforts of field units within the shift or division. - VII. Keep subordinates informed of matters affecting them and their subordinates. VIII• Shall advise the Chief of Police of any problems or situations that exist either within the department or City of McHenry with their recommendations for solving or improving said situation. IX. Perform those duties necessary for the shift or division field operations as directed by the Chief of Police and all other duties, as assigned. Sergeants of the McHenry Police Department Purpose This order defines the.authority,and responsibilities of the Sergeants of Police. Authority Sergeant of Police shall: I. Receive direction from and be responsible to the Lieutenant of Police. II. E_--ercise direct authority over all subordinates, facilities and activities as assigned. III. Assume command of field operations when so directed by the Lieutenant or -higher authority. IV. Relieve from duty status any subordinate found in a condition detrimental to the McHenry Police Department. 1. Upon taking such action a written report•will be directed to the shift commander, through proper channels, containing recommendations for disciplinary action together with all reports pertaining to the incident. 2. All acts and decisions of the Sergeant of Police are subject to review by the Lieutenant and all higher authority. General Responsibilities Sergeant of Police shall: I. * Serve as staff to the Lieutenant, assisting in the formulation of shift operations and objectives, developement of plans to accomplish objectives and coordination of shift operations. II. Be responsible for effective command and supervision of field personnel, facilities and activities assigned; insuring compliaice with existing policy, rules, directives and orders of the Chief of Police and all intermediate commands. • III. Exercise police pow.er and have supervisory authority,.commen— surate with rank. Be accountable to a Lieutenant for super— vision of shift.operation assignments during assigned duty , hours. (17) Specific Responsibilities Sergeant of Police Shall: I. Carry out all administrative assignments. II. Direct and coordinate activities of subordinates assigned to specific shift or division. III. Evaluate subordinates by use of the written evaluation form. This is to be done on a quarterly basis. IV. Inspect all subordinate police vehicles for cleanliness, damage and equipment. This is to be done on,a monthly basis. V. Investigate accidents involving police vehicles and make a written report with comments and recommendations, regarding said_ accident_ to be -for-warded to _the Chief of Police, through proper channels. F• �1 VI. Evaluate priorities for the assignment of personnel during his assigned tour of duty. VII. Insure that all field reports are reviewed and signed. This includes reviewing all citations, booking sheets; non -traffic,• parking tickets and all paperwork turned in by subordinates. VIII. Provide for the preparation and supervision of special mobil- ization plans for events taking place during assigned duty hours (football games, basketball games, concerts etc.). IX. Assist patrolmen in resolving problems by advise and counsel and by coordinating the -efforts of units assigned during duty hours. X. Keep subordinates informed of matters affecting them and their subordinates. XI. Supervise the inspections of personnel, facilities and activities assigned. XII. Inspect, semi -formally, subordinates assigned to shoft or division.- This is.to be•done on-a'daily basis. XIII. Make themselves totally aware of all rules,:regulations, policies and procedures and any additions, deletions and changes. - XIV. - Advise in writing to. -their immediate superior officer any. problems or situations that exist either on the shift, within the division, within the department or within the City of McHenry with their recommendations for resolving or improving of said problem or situation. XV. Perform any other duty as directed by'the Lieutenant and all higher authority. Patrolman of the McHenry Police Department Purpose This order defines the responsibilities of the Patrolman of Police. It is the policy of the McHenry Police Department to determine respons— ibility thereby establishing accountability directed towards maximum efficiency throughout the department. Responsibilities Patrolman of Police shall: I. Be accountable to the 'sergeant of Police and all higher authority for all actions and decisions they make. This accountability is twofold._ The_.Sergeant and- all _higher_ authority are also- accountable -for -your actions. - Perform such duties as designated by their next superior officer. III. Keep themselves ready for inspection at all times. IV. Inspect their assigned vehicles for cleanliness, damage and equipment. V. Comply with all orders issued or assigned by their superior officers. VI. Advise their immediate superior officer of any problems or situations that exist either on their shift, within the department or within the City of McHenry.' with their recommendations for solving or improving the problem or situation. (20) TRAFFIC CITATIONS I. Police personnel of the McHenry Police Department shall be issued and made responsible for the Uniform Traffic Citation book. Each numbered . ticket contained in this book shall be the responsibility of the officer to whom it was issued. II. Each ticket issued shall be thoroughly completed. All pertinent -in— formation will be recorded legibly and completely so as to secure all evidence presented in court. III. All traffic citations shall be issued with the outmost courtesy and professionalism. This shall be uppermost'in each officers approach on every stop made --traffic or otherwise. IV. It shall be the responsibility of every officer to answer the court call of each citation issued. 1. Illness • A. In case of officers illness the shift commander of the Lieutenant of Police will be notified without delay in case of a court -date which will be missed. V. Lost, damaged or void traffic citations. 1. In the event that a traffic citation is lost, void or damaged, the officer to whom the citation was assigned will hand write a supplementary report to the Shift Commanding Officer explaining the circumstances involved.' If the citation is damaged or void it will be returned to the Shift Commanding Officer, attached to the supplementaryreport. The supplementary report shall= -be signed by a supervisor. VI. Under no circum§tancefshall an arresting officer take a cash bond on the street. All cash bonds are to -be taken at the front desk of the Police Department. (21) VEHICLE REGULATIONS Purpose The following rules and regulations for vehicle operation are set down for the purpose of safety mainly for police personnel and citizens of this community. 1. Emergency operation. There cannot be a rigid, clear cut definite set of rules set down for a police officer to adhere to in the emergency operation of a police vehicle. Each incident, call or situation must be accepted on it's own merit and each^such situation will demand that the police officer make a decision for just that situation. The rules adopted shall be adhered to as an aid in guiding the individual police officer in making these individual decisions. A. In emergency situations where red lights and sirens are used, extreme caution will be observed. B. Police personnel, operating•a vehicle in an emergency situation, shall slaw the vehicle at all main intersections being sure that the inter— section is clear before proceeding through. C. Police personnel shall assist another emergency vehicle, only when directed to do so by a superior officer or when called upon for assistance. I D. Police personnel shall assist other jurisdictions in direct pursuit of a suspect wehicle only when directed to do so by a superior officer. E. Police personnel shall continue a pursuit outside the McHenry City limits only when directed to do so by a superior officer. F. Police personnel operating a•vehicle in an emergency situation, shall- _ decide when to abandon the pursuit, if not oidered prior, by a superior officer. G. Police personnel shall not use or attempt to set up any type of road block except in an extreme emergency and then only on the order of and at the direction of a superior officer. II. District patrol A. Police personnel shall in answering a call, park the squad in a lawful or assigned parking space except, naturally, when neither is available. B. When leaving the squad, police personnel shall turn off the motor -and .- take the igition key. C. • Police personnel shall when checking their patrol districts, cruise at a speed which will enable the officers to observe everything within sight or hearing (a man driving at 20 miles per hour sees twice as much and in detail, than a man driving 40 miles per hour). (22) D. Police personnel in checking business districts, both front and rear, will use extreme caution for any hidden abutments, pot holes or hidden objects that will inflict damage on the squad cars. E. Police personnel in checking business districts shall observe all stop lights, stop signs and other traffic regulations, and further, will not drive on the wrong side of the street. III. Care and inspection of police vehicles. A. Police personnel shall at the time of their daily assignment to a squad and prior to commencing their tour of duty, shall inspect the vehicle for any damage and/or malfunction. B. Police personnel shall inspect the assigned vehicle for general cleanliness. C. Police personnel shall report in writing to their next superior officer any general uncleanliness observed. D: Police personnel shall report in writing any malfunction or repair work needed. E. Police personnel shall never write on any interior fabric, scratch the - dash board with their shoes, set coffee cups anywhere on.:or in said vehicleg nor in any way mar, mark or deface the vehicle intentionally or through laxity. F. Police personnel shall inspect the vehicle for the following equipment: _ Spare tire, flares, fire extinguisher, blankets, first aid kit and any other equipment specified. If any of the above equipment is found lacking, the officer shall make a written report to his immediate superior officer. G. Police personnel shall, prior to beginning their tour of duty, inspect the following: Mars light, siren, spotlights, headlights - bright and dim; taillights, turn signals, radio equipment, and interior dome light. At the failure bf any of the above equipment, the officer shall note this on the repair slip. H. Police personnel shall be responsible for the cleanliness of police vehicles assigned. I. Police personnel shall when parking at the station or when alighting from the vehicle at any time, engage the emergency brake and place the vehicle in the parking gear. J. Police personnel shall notify the station immediately when involved in any motor vehicle accident no matter how minor it may be. R. All-notor vehicle 'accidents involving a police vehicle shall be invest- igated by a' ranking officer, sergeant or above. , L. Police personnel shall submit a written report on any accident and/or damage involving a police vehicle. (23) TRAFFIC INVESTIGATIONS urpose: The following policy, procedures, rules and regulations are set forth to enhance_ the professional image of the McHenry Police Department. This projection of profession- alism is not only targeted toward the citizen we serve but to our peer groups in the field of Law Enforcement. These polices, procedures, rules and regulations are not proported to be ex- haustive. All officers of the McHenry Police Department are responsible to make themselves aware of all changes, additions or deletions. ACCIDENTS -SHIFT COMMANDER Fatal' and Serious Personal Injury Accidents. I. -The Shift Commander shall be noti€ied - immediately of any accident involving serious personal injury or injury likely to result_ in a _fatality. . When possible,-- officers should be -guided by the opinion of a physican: II. The Shift Commander will notify the Lieutenant of Police when in his opinion,. the injuries sustained in an traffic accident are such that the injury could - result in a fatality. III. The Lieutenant of Police and/or Chief of Police will be notified of all fatal traffic accidents. IV. The Shift Commander shall be responsible for notifying the coroner in any and all traffic fatalities. V: The Shift Commander -shall, at his' discretion, notify the Northern Illinois Crime Laboratory if in his opinion their assistance is needed. VI. Police personnel shall, when arriving at the scene of an accident, place the following in priority: I. Aid the Injured. 1. An ambulance shall be called to the scene if needed or requested by any person involved. 2. The officer shall give first aid if necessary. II. Protect the Scene. -- 1. The officer shall position his squad in a manner that will protect the scene and the injured. The squad shall have in operation all necessary emergency equipment. .1. Mars lights. 2. Deck flashers 3. headlight flashers 4. Four-way flashers 5. Officer shall utilize flares if necessary. (24) ACCIDENTS--INVESTIGATIN G I. Find and identify drivers and witnesses. II. Measure to locate final position of vehicles and bodies of persons killed or incapacitated.' III. Measure to locate marks on road and debris. IV. Make preliminary examination of condition of vehicle equipment such as brakes, tires, steering and head lamps. V. Make attempt to match damage of vehicles to marks on the road and one vehicle to the other. VI. Prepare a diagram of accident scene showing exact location of accident, position of vehicles and all physical evidence. VII. When vehicles are not driveable, the preferred tow truck of the vehicle owner shall be called._ If there is no preference, the police department dispatcher -shall dispatch :a tow truck._ VIII. The officer shall obtain all necessary information for completion of the Police Accident Report. IX. Photographs of the scene shall be taken if needed, in accordance with the departments policy. X. The investigati officer shall determine the factors causing the accident and shall issue raffic citations, when applicable, to any or all operators of vehicles in violation of any ordinance or statute. IX. -When the officer is unable to obtain information from any person involved, . due to injury, removal from the scene, or other reasonable cause, the officer shall forward a detailed supplementary to the next shift commander with all available information. XII. If the accident is of a very serious nature, the shift commander shall be notified. HIT AND RUN ACCIDENTS I. Investigating officer shall obtain a complete physical description of offend— ing driver/passenger. Sex, race, approximate height, build, hair and other unusual or outstanding characteristics. All investigative work will be recorded on a Supplementary report, which will be attached to'original report. 1. Phone calls, investigations, apprehensions all must be recorded. 2. Activity procedures, date, time and officers name must be on each individual entry on Supplementary report. ACCIDENTS INVOLVING RAILROAD TRAINS I. The investigation of -accidents of accidents involving railroad trains will be expeditiously completed in order that the train may proceed with a minimum delay. II. When Communications is notified os an accident involving a railroad train, the dispatcher will: 1. Assign a Police Unit to according to ACCIDENT INVESTIGATING. 2. Notify the shift commander. 3. Notify, as soon as possible, the nearest headquarters of operation of the railroad involved. III: The shift commander, when informed*of a serious or unusual accident involving a railroad train, will immediately notify the Lieutenant of Police and/or the Chief of Police. IV. The investigating officer of an accident involving a railroad train will: 1. Complyuwith ACCIDENT INVESTIGATING. 2. Determine whether additional equipment or assistance is needed. 3. Notify the train operator to notifiy his railroad police immediately. V. The investigating officer shall check all railroad crossing signals and record any discrepancy regarding their proper functioning. 1. If any malfunctioning of the railroad crossing signals is dis— covered, the proper authority shall immediately be notified and an officer, as designated by the Shift Commander, shall remain at the location of the malfunctioning signal until arrival of authority or repair of signal is completed. VI.. This section applies to train Vs- train, train vb motor vehicle, train vs pedestrian and train vs'bicycle accidents. (26) WEAPONS ---ON DUTY PURPOSE: The following policy, procedure and rules are implemented to regulate the types of weaponry to be used by the members of the McHenry Police Department and to standardize the training in the use of such weapons. POLICY: It is the policy of the McHenry Police Department, that only those weapons issued and/or owned by the City of McHenry will be used in the regular day to day operations of the Police Department. Any diviation from this policy will be by permission of the Chief of Police. The use of any weapon by a member of the McHenry Police Department will be governed by Chapter 38 of the Illinois Revised Statutes (Chapter 38, Section 7-24). J RULES: 1. Only those weapons issued and/or owned by the City of McHenry shall be worn or used by Police Officers on duty. . 2. Only that ammunition issued by the City of McHenry shall be used or carried by members of the McHenry Police Department. 3. All Police Officers will qualify at least twice annually at regular Departmental Firearms Training Sessions with a minimum score of 60% at each qualification. 4. It shall be the responsibility of each Officer to submit his signed score sheet to the senior Officer present, to be placed in his personal jacket. S. In any incident, where a weapon is fired by a City of McHenry Police Officer, that Police Officer will turn the weapon over to the first command Officer arriving at the scene as soon as practical. All Officers will note implicitly that it is the individual Officers choice to be armed while in his off duty s atus dnd that in doing so, he assumes all those responsibilites demanded while in uniform and on duty. POLICY: It is the policy of the McHenry Police Department that those Police Officers of the McHenry Police Department who are armed while off duty shall comply with the below listed rules and procedures, prior to and during that time they are armed while off duty. Further, it shall be the responsibility of all sworn personnel of the McHenry Police Department to be totally familiar with the policy, procedures and roles of carrying weapons off duty as implemented and any additions, deletions or corrections which may be implemented in the future. PROCEDURES: McHenry Police Officers will submit for inspection to the Chie£•of Police or in his absence the Lieutenant of Police, any. and all weapons to be carried by -the individual Police Officer in his off duty status. This procedure is implemented to prohibit the ' carrying of inferior weaponry by Police Officers which would pose a danger to both citizens, innocent by-standers and the Police Officer as well. Further, it will standard! and regulate the caliber and type of weapon to be carried, and the training demands of the Department. After inspection, all pertinent information will be duly noted on an Interdepartmental memorandum and placed in the Officers personal jacket. RULES: I. TYPES & CALIBER A. Any and all weapon submitted for inspection to be carried off duty, shall bey in excellent Working order. Any safe device i.e.; thumb safe, grip safe, half cock, cylinder lock, etc, that is not functioning properly will disqualify the weapon for use. j B. When a semi -automatic pistol is submitted, the Officer will field strip the weapon during inspection demonstrating a working knowledge of that particular weapon. C. Calibers of submitted weapons shall be no less than .32 nor more than 9 mm ( .32, .380 .38/.357; 9mm) D. A11 ammunition used shall be standard factory load. Absolutely no magnum loads Will be used. The bullet shall be a round nosed Lead bullet or a semi-jacketel bullet. 11. HOLSTERS A. All weapons worn off duty Will be holstered. B. It is expected of, and the duty of, each individual Officer to report for duty, with as little time lost as possible, and ready to confront any emergency situation to his utmost ability. PROCEDURE: Any and all outside employment permission requests shall be in writing, submitted to the Shift Commander. The Shift Commander will either approve or disapprove this request and forward it on thru the Chain of Command to the Chief of Police for final approval or disapproval. All requests for permission to engage -in outside employment shall state the -- name of the company or business, type of employment and the time and total hours per day and week to -be worked.
