ALTHOFF & ASSOCIATES FOR ) A SPECIAL USE FOR THE PROPERTY LOCATED ) AT 804 MILL STREET, MCHENRY, ILLINOIS. ) ORDINANCE WHEREAS, Petitioners did file a Petition with the Zoning Board of Appeals of the City of McHenry requesting a Special Use to allow a privately owned recreation building under the provisions of the Zoning Ordinance of the City of McHenry, McHenry County, Illinois as adopted on the 12th day of March, 1962 and subsequently amended, in reqard to the premises located at 804 Mill Street, McHenry, McHenry County, Illinois and more fully described as follows: That part of Sections 27 and 34, Tovmship 45 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the Northeast corner of said Section 34; thence Southerly along the East line of said Section 34, a distance of 38.34 feet for the place of beginning; thence continuinc_t Southerly, along said East line, a distance of 282.36 feet to the Northeasterly line of Mill Street; thence Northwesterly along the Northeasterly line of Mill Street, a distance of 479.2 feet; thence Northeasterly, alonq a line which forms an angle of 81 degrees 08 minutes to the right with the prolonga- tion of the last described course, a distance of 216.3 feet; thence Southeasterly, a distance of 309.88 feet to the place of beginning, being situated in McHenry Township, McHenry County, Illinois. AND, WHEREAS, a Hearinq on the full contents of the said Petition was had before the Zoning Board of Appeals of the City of McHenry in compliance with the Zoning Ordinance of the City of McHenry, McHenry County, Illinois as adopted on the 12th day of March, 1962 and subsequently amended; AND, WHEREAS, as a result of the taking of testimony and the viewinq of Exhibits as presented at said Hearing by Petitioner and Second Party Petitioner, the Zoning Board of Appeals of the City of McHenry did recommend to the City of McHenry City Council that it issue a Special Use as would be required to allow Petitioners to use the premises for a privately owned recreation building. NOW, THEREFORE, BE IT ORDAINED that the Petitioners are granted a Special Use of the premises described hereinabove to permit the Petitioners to utilize the premises for a privately owned recreation building. BE IT FURTHER ORDAINED that the Petitioners have fully met the requirements and standards for a Special Use as set forth in Article XV, Section C of the City of McHenry Zoning Ordinance. This ordinance shall be in full force and effect from and after its passage as by law required. PASSED this 9th day of September, 1981.
