ORDINANCE NO.
AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE CITY OF McHENRY, ILLINOIS
WHEREAS, a written Petition by the McHENRY STATE BANK,
as Trustee under the provisions of a Trust Agreement dated January 4, 1979 and
known as Trust No. 1693 and by GUSTAV ROBERT ROALSEN, being owner of
100% of the beneficial interest under said Trust, has been filed with the City Clerk
of the City of McHenry, Illinois, requesting an amendment under the provisions
of the Zoning Ordinance of the City of McHenry, and such Ordinance as amended,
concerning the following described real property, to -wit:
PARCEL 1: The Westerly Half of Lots 7, 10 and 11 in Block 13 in
the Original Plat of McHenry, on the West side of Fox River, a sub-
division of part of the Southeast Quarter of Section 26, Township
45 North, Range 8 East of the Third Principal Meridian, according
to the Plat thereof dated July 6, 1840 and recorded in Book B of
Deeds, page 160, in McHenry County, Illinois; ALSO
PARCEL 2: Commencing at the Southwest Corner of Lot 11 in Block
13 in the Original Plat of McHenry, on the West side of Fox River,
according to the Plat thereof dated July 6, 1840 and recorded in
Book B of Deeds, page 160, and running thence Westerly on the North
line of Pearl Street, 2 rods; thence Northerly at a right angle with
Pearl Street, 12 rods; thence Easterly 2 rods and to the Northwest
Corner of Lot 7; thence Southerly on the West line of Lots 7,, 10
and 11 in Block 13 to the place of beginning, being in the Southeast
Quarter of Section 26, Township 45 North, Range 8 East of the Third
Principal Meridian, in McHenry County, Illinois.
WHEREAS, said Petitioners are the owners of the above described
premises, and;
WHEREAS, Petitioners are requesting an amendment and reclassification
of the aforesaid property from "R-3" Single Family District to "B-1" Commercial
District, and;
WHEREAS, a hearing was had before the City of McHenry Zoning
Board of Appeals on Friday, the 19th day of September, 1980 and continued on
October 3, 1980 at which times the said Zoning Board of Appeals did take evidence
and view exhibits presented thereat by the Petitioners and said matter was continued
to 2:30 P.M. October 10, 1980 for decision and;
WHEREAS, on October 10, 1980, the Zoning Board of Appeals did
by a vote of 6 for and none opposed recommend to the City Council the granting
of said amendment and reclassification, and;
WHEREAS, as the regular meeting of the City Council held on Monday,
the 20th day of October, 1980, the Council did elect to consider the requests of
the Petitioners, and;
WHEREAS, as a result of such consideration, the City Council of
the City of McHenry did affirm the recommendation of the Zoning Board of Appeals
of the City of McHenry concerning the prayer for amendment and reclassification
as filed by the Petitioners, and;
NOW THEREFORE, BE IT ORDAINED by the City Council of the
City of McHenry, Illinois, that the Zoning Ordinance and Zoning Maps of the City
of McHenry, Illinois be and the same are hereby amended to reclassify the above
and aforesaid property from "R-3" Residence District to "B-1" Commercial District.
BE IT FURTHER ORDAINED that this Ordinance shall be in full
force and effect from and after passage, approval and publication as provided
by law.
