HomeMy WebLinkAboutOrdinances - O-80-229 - 06/02/1980 - ANNEX LAND ABUTTING FOX RIVER0-80-229 AN ORDINANCE WHEREAS, the City of McHenry, Illinois, is located on the banks of the Fox River; and WHEREAS, it is desirable and in the public interest of the citizens of the City of McHenry, Illinois, that land be acquired on the banks of the Fox River for municipal park and recreational purposes; WHEREAS, the premises hereafter described are located on the banks of the Fox River and'are adjacent to andabutting upon land which is already owned by the City of McHenry, Illinois, and already included within its corporate boundaries; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, AS FOLLOWS: Section 1. That it is hereby determined that it is useful, advantageous, necessary and desirable for the municipal purposes and public welfare of the citizens of the City of McHenry, Illinois, to acquire the following described premises for municipal park and recreational purposes: Parcel 1: Part of the Northwest Fractional Quarter of the North- west Fractional Quarter of Section 1, Township 44 North, Range 8 East of the Third Principal Meridian, which lies West of the cen- ter of Fox River and which lies East of the West 27.5 acres of the Northwest Fractional Quarter of Section 1, Township 44 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois (excepting therefrom that part of the Northwest Frac- tional Quarter of the Northwest Fractional Quarter of Section 1, Township 44 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the Southwest Corner of Lot 26 in Wheeler's First Addition to McHenry Country Club; thence South parallel with the West line of said Fractional Quarter Quarter Section, 30.0 feet; thence East parallel with the North line of said Fractional Quarter Quarter Section, 225 feet, more or less, to the water's edge of Fox River; thence Northerly along the water's edge of said river to the North line of said Frac- tional Quarter Quarter Section; thence West to the place of be- ginning, in McHenry County, Illinois. Parcel 2: The North Half of the Fractional Southwest Quarter of the Fractional Northwest Quarter of Section 1, Township 44 North, Range 8 East of the Third Principal Meridian, lying on the Wes- terly side of the Fox River (except the West 60 feet thereof; also excepting therefrom that part conveyed by Edmund Knox and Wife, to Edwin O. Sullivan and Wife, by Deed Recorded in Book 184 of Deeds, page 532; also excepting therefrom that part conveyed by Edmund Knox and Wife, to Theodore J. Wiedemann by Deed Recorded in Book 193 of Deeds, page 142), in McHenry County, Illinois. Parcel 3: An easement for the benefit of the above described property (Parcel 2) over the following described real estate: Beginning at the Northwest corner of Lot 1 in Idyl Dell Subdi- vision, -a Subdivision of part of the South Half of the North- west Quarter of the Fractional Section 1, Township 44 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded January 14, 1922, as Document No. 53615, in Book 4 of Plats, page 46, in McHenry County, Illinois; thence West along the North line of said Lot 1 extended Westerly a dis- tance of 185 feet to a point of beginning; thence North along a line parallel to the West line of Section 1 aforesaid to its intersection with the North line of the South Half of the Frac- tional Southwest Quarter of the Fractional Northwest Quarter of said Section 1; thence West along said North line, 60 feet to a point; thence South along a line parallel to the West line of said Section 1 to its intersection with the North line of Lot 1 aforesaid extended Westerly; thence East to the point of begin- ning, in McHenry County, Illinois. Section 2. That the law firm of Narusis & Narusis be and it is hereby authorized and directed to negotiate with the owner or owners of record or parties interested in the premises described in Section 1 above for the purpose of agreeing to compensation to be paid for said premises. Section 3. In the event that the City of McHenry, Illinois, is unable to agree with the owners of said property as to the compen- sation to be paid therefor, then title to and possession of said real property legally described in Section 1 of this ordinance shall be acquired by the City of McHenry, Illinois, through condemnation, and Narusis & Narusis, as attorneys for the City of McHenry, Illinois, are hereby authorized, empowered and directed to institute proceedings in any court of competent jurisdiction to acquire title to and possession of said property for said City in accordance with the eminent domain laws of the State of Illinois. Section 4. That this ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. Section 5. That this ordinance shall be in full force and effect . from and after its passage and approval according to law. -2- m PASSED THIS 2nd DAY OF June , 1980.
