HomeMy WebLinkAboutOrdinances - O-79-209 - 10/11/1979 - AMEND ZONING ORDORDINANCE NO. 0-79- 209 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF McHENRY, ILLINOIS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, ILLINOIS, as follows: SECTION 1. That the Zoning Ordinance of the City of McHenry, Illinois, heretofore adopted on the 12th day of March, 1962, and the Zoning Map adopted as a part thereof, and as said Zoning Ordinance and as said Zoning Map have been subsequently amended, be and the same are hereby amended by zoning and classifying the property described in the attached Exhibit 1 as "R-1 Single Family District" subject to a Special Use for a Planned Unit Development in accordance with the following: A. Those areas designated "B-3 Zoning" on the attached Exhibit 1 shall be developed in accordance with all the provisions of the "B-3 Commercial District" classification as set forth in the Amended Zoning Ordinance of the City of McHenry, subject, however, to the following restrictions and limitations: (1) The following "B-3 Commercial District" uses shall not be permitted on the premises described as Lots 2, 3, 4 and 5 on Exhibit 2 which is attached hereto and made a part hereof: (a) Agricultural implement sales and services; (b) Auction rooms; (c) Beverage Distributors, but not including bottling plants; (d) Book binding; (e) Expressing, baggage, and transfer delivery service; (f) Garages or lots, public or private, for storage of passenger automobiles, trucks or buses; (g) Taxi cab operations; (h) Trailer sales; and (i) Used car lots. (2) As to Lots 2, 3, 4 and 5 on said Exhibit 2, the permitted "B-3" uses of "Plumbing, heating, electrical, roofing and supply contractors, including the customary workshop", all such permitted activities shall be within an enclosed building with no outside storage. (3) As to Lots 2, 3, 4 and 5 on said Exhibit 2, the permitted "B-3" uses of "Wholesale Establishments" shall be defined as including only general merchandising estab- lishments, factory outlet centers for the general public, sales establishments offering discounted merchandise to the general public, catalogue sale and distribution centers, cooperative distribution centers and similar general mer- chandising establishments but shall specifically exclude warehouse job -lot merchandising, auction show rooms and auction sales facilities, salvage sale centers and open air markets. B. That area designated as "R-4A Multi -Family District" on the attached Exhibit 1 shall be developed in accordance with the provisions of the "R-4A Multi -Family District" classification as set forth in the Amended Zoning Ordinance of the City of McHenry, McHenry County, Illinois. C. Those areas designated as "R-3 Zoning" on the attached Exhibit 1 shall be developed in accordance with the provisions of the "R-3 Single Family District" classification as set forth in the Amended Zoning Ordinance of the City of McHenry, McHenry County, Illinois. D. The area designated as Lot 1 on said Exhibit 2 may be developed for use as a recreational and sport center to include racquet ball and skateboard facilities. SECTION 2. That each special use set forth in Section 1 hereof is authorized upon the finding hereby that: A. The special use will not cause substantial injury to the value of other property in the neighborhood in which it is located. -2- B. The location and size of the special use, nature and intensity of the operation involved in or conducted in connection with it, the size of the site in relation to it, and the location of the site with respect to streets giving access to it, shall be such that it will be in harmony with the appro- priate and ordinary development of the district in which it is located. C. The location, nature and height of buildings, walls and fences and the nature and extent of the landscaping on the site shall be such that the use will not hinder or discourage the appropriate development and use of the adjacent land and buildings, or will not impair the value thereof. D. Parking areas shall be of adequate size for the particular use, properly located, and suitably screened from adjoining residential uses, and the entrance and exit drives shall be laid out so as to prevent traffic hazards and nuisances. E. The uses permitted by any exceptions are necessary and desirable and appropriate to the purpose of the development. F. The uses permitted in the development are not of such nature or so located as to exercise a detrimental influence or effect upon the surrounding neighborhood. G. That no industrial areas will be established in the Planned Unit Development. H. That all minimum requirements pertaining to com- mercial, residential, institutional or other uses established in the Planned Unit Development will be subject to the require- ments for each individual classification as established elsewhere in the Ordinance, except as may be specifically varied herein. SECTION 3. That such classification is made pursuant to the affirmative findings and recommendation of the Zoning Board -3- of Appeals of the City of McHenry voting upon the application, following proper publication of notice, public hearing and pre - hearing conferences, all in accordance with the provisions of the Zoning Ordinance. SECTION 4. That all Ordinances, or parts thereof, in conflict herewith be and the same hereby are repealed. SECTION 5. That this Ordinance shall be in effect from and after its passage and approval, according to law. PASSED this llth day of October , 1979. AYES: Nolan, Pepping, Datz, Harker. Adams, Wieser, Schooley.
