AN ORDINANCE GRANTING A SPECIAL USE PERMIT
WHEREAS, an application for the issuance of a Special Use
Permit under the Zoning Ordinance of the City of McHenry, Illinois,
for the construction, operation and maintenance of a child care
center on the premises described in Section 1 hereof was duly filed
and regularly heard by the Zoning Board of Appeals pursuant to
proper notice first having been given; and
WHEREAS, the subject property is zoned as B-1 Commercial
Retail District under the Zoning Ordinance of the City and the
Zoning Board of Appeals did expressly find that:
(a) the special use will not cause substantial injury
to the value of other property in the neighborhood in which
it is to be located;
(b) the location and size of the special use, the
nature and intensity of the operation involved in or
conducted in connection with it, the size of the site
in relation to it, and the location of the site with
respect to streets giving access to it, shall be such that
it will be in harmony with the appropriate and orderly
development of the district in which it is to be located;
(c) the location, nature and height of buildings, walls
and fences, and the nature and extent of the landscaping
on the site shall be such that the use will not hinder or
discourage the appropriate development and use of adjacent
land and buildings, or will not impair the value thereof;
(d) parking areas shall be of adequate size for the
particular use, properly located, and suitably screened
from adjoining residential uses, and the entrance and
exit drives shall be laid out so as to prevent traffic
hazards and nuisances;
and did recommend to the City Council that the said Special Use be
granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF McHENRY, ILLINOIS, as follows:
SECTION 1. That a Special Use Permit is hereby granted
to construct, operate and maintain a child care center on the
following described premises, to -wit:
The West 100 feet of Lot 100 as measured along the
North line in Pheasant Valley Unit No. 1 being a
subdivision of part of the Northeast and Southeast
quarters of Section 28, Township 15 North Range 8
East of the Third Principal Meridian according to
the plat recorded October 6, 1978 as Document No.
748712, McHenry County, Illinois;
on the conditions that fifteen parking spaces shall be furnished
on the premises and that a walkway at least four feet in width
shall be constructed and maintained from the driveway to the
building, all as depicted on the plan prepared by Clayton Surveying
& Engineering Co. of St. Louis, Missouri, a copy of which is
attached hereto, marked Exhibit "B", and incorporated herein by
reference.
SECTION 2. That the City Council expressly finds that:
(a) the special use will not cause substantial injury

it is to be located;

nature and intensity of the operation involved in or
conducted in connection with it, the size of the :site
in relation to it, and the location of the site with
respect to streets giving access to it, shall be :such that

and fences, and the nature and extent of the landscaping
on the site shall be such that the use will not hinder or

(d) parking areas shall be of adequate size .for the
particular use, properly located, and suitably screened
from adjoining residential uses, and the entrance and
exit drives shall be laid out so as to prevent traffic

SECTION 3. All ordinances, or parts thereof, in conflict
herewith be and the same are repealed to the extent of such conflict.
SECTION 4. That all maps, plats, journals and other records
including the zoning district map of the City of McHenry be and the
same are hereby amended to reflect the granting of the Special Use
Permit to the above -described real estate.
SECTION 5. That this Ordinance shall be in full force and
effect from and after its passage and approval as required by law.
