AGENDA ITEM SUMMARY:
Staff requests City Council to consider accepting the proposal from Advanced Automation &
Controls, Inc. of McHenry, IL to replace and upgrade the current SCADA server and software.
BACKGROUND:
The SCADA (Supervisory Control and Data Acquisition) sever is a computer used to monitor and
control the City's four water treatment plants and four elevated storage tanks (water towers).
The SCADA server monitors all water treatment processes and has alarms set to notify Water
Division employees in the event that something goes wrong at a City facility.
The current SCADA server was installed in 2009 and is 11 years old. It is recommended that the
server be replaced every 5 or 6 years, which is the standard adhered to by Information
Technology staff with regard to other critical City network servers.
In addition,the current software used to operate the Water Division's SCADA system is outdated
and is no longer supported by the manufacturer.
At the present time the City Of McHenry utilizes two different SCADA system integrators.
Advanced Automation and Controls Inc. is the SCADA system integrator for the Wastewater
Division and Concentric Inc. is the SCADA system integrator for the Water Division.
ANALYSIS:
The City of McHenry solicited and received quotes from both of the SCADA system integrators:

Advanced Automation and Controls: $20,365.00. This quote includes a second computer
to serve as a back-up server.
Concentric Integration, Inc.: $36,000
RECOMMENDATION:
Therefore if Council concurs, it is recommended to accept the proposal from Advanced
Automation and Controls of McHenry, IL in an amount not to exceed $20,365.00 to replace the
Water Division SCADA server and upgrade the operating software.

AGENDA ITEM SUMMARY:
An application has been submitted by Paul Abbott for the purpose of holding a block party on
Saturday, August 22nd, between 12:00 p.m. and 10:00 p.m. They are requesting temporary
closure of Jennifer Lane from Prestwick to Orleans Street.
BACKGROUND:
The City of McHenry allows block parties on all residential streets providing they do not block
intersections, cul-de-sacs or other roadways. To schedule a block party, City residents submit an
application to the City Administrator's office. There is no fee for the permit. Once approved,
only moveable barriers (sawhorses) that are dropped off and picked up by Public Works can be
used to control traffic. Blocking streets with vehicles is prohibited.
COVID-19 Issue:
The applicants have been made aware that they must follow all guidelines from the State of
Illinois Governor's office regarding gatherings and social distancing protocols. At present time,
no more than 50 people are permitted to gather. This is per Phase 4 guidelines.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended a motion be made to approve the block
party request as presented. Public Works will provide barricades and the McHenry Township
Fire Protection District and Police Department will be notified of the event.

Call to Order: The City Council of the City of McHenry, Illinois, met in regular session on
Monday, August 3, 2020, at 7:00 p.m. via Zoom due to the COVID-19 pandemic in
compliance with the Open Meetings Act per guidelines by the Illinois Attorney General's

B. Motion to adopt Ordinances granting a Zoning Map Amendment and Minor Variances
to allow 68.5% of uncovered space in lieu of the required 73% uncovered space to
accommodate a 4-unit attached single family residence for the property located at 1208
N. River Road. (Community Director Polerecky)
Alderman Schaefer wanted to know if there is an aerial of this, he likes to look at it from the air
regarding density, photography wise, no further questions from him. Questioned the amount
of people per acre. Where the trend of development is per Alderman Glab, most things there
are all commercial. City Planner Sherriff, stated that they exceed the minimum requirements of
the lot areas. Alderwoman Miller likes the idea thinks it will help with improvement of others.
A motion was made by Alderman Santi and seconded by Alderman Schaefer to approve

B. Route 31 Reconstruction Local Improvement Participation- troy strange explained the
local participation regarding this discussion item, needs some clarity on this. Where is
council at regarding multi-use paths and sidewalks. Sidewalks along state routes are

constructed regarding the municipality The City of McHenry, these are ours to maintain.
Many council members shared their views. Multi-use path is very favored by
Alderwoman Miller. Many support the multi-use path during this conversation. Much of
the council was on board with lighting of the streets. This discussion went on for some
time.
Staff Reports.- Director Hobson stated that boat rental could be in by this weekend or next
weekend. The pool at the merch aquatic center will be opening as well.
Mayor's Report: None
City Council Comments: Comments on 7 elevens vs. Speedway regarding gas stations.
Executive Session: Not at this time.

AGENDA ITEM SUMMARY:
City staff are requesting approval of text amendment(s) to Chapter 13: Fences of the City of
McHenry Municipal Code to allow the availability for residential fence variances to be processed
through the Administrative Variation process as defined in §11-19-3 of the City of McHenry
Zoning Ordinance.
BACKGROUND:
On May 4, 2020, City Council approved various text amendments to the City of McHenry Zoning
Ordinance that allowed minor variances (residential variances)to be processed administratively.
Fences are exclusive to the City of McHenry Building Regulations and therefore would not be
eligible for this process under the existing ordinance. City Staff is requesting approval to allow
residential fence variances to be processed administratively.
RECOMMENDATION:
If the City Council concurs it is recommended the attached ordinance approving text
amendments to the City of McHenry Municipal Code be approved (Mayor and City Council
vote-simple majority).
ORDINANCE NO 20-
AN ORDINANCE ADOPTING TEXT AMENDMENTS TO THE CITY OF MCHENRY MUNICIPAL CODE
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, the City Council of the City of McHenry approved Ordinance 20-20 on May 4,
2020 to allow staff to process minor residential variances administratively; and
WHEREAS, the City of McHenry desires to amend its Municipal Code to allow residential
fence variations to be processed administratively.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That Section 10-13-1(C) and Section 10-13-1(D) of the City of McHenry
Municipal Code is hereby repealed and replaced with the following language:
C. Relief From Restrictions: Applications for Residential Fence Permits that require relief from
restricts may be reviewed and approved administratively. The Zoning Administrator will review
and approve administrative variations for residential fence permits that meet the following
standards:
1. A complete application has been filed with the Zoning Administrator.
2. A notice has been delivered via certified mail, return receipt requested, to
adjacent property owners that are abutting or across a public right-of-way.
3. No written objections have been received. If any noticed property owner files a
written objection to the administrative variation within fifteen (15) calendar days
of receipt of such notice or if the Zoning Administrator believes approval of the
request would create an adverse condition, the administrative variation shall be
denied.
a. If denied, the property owner may appeal the decision to be considered
by the City Council. Other procedures and requirements shall be as
provided for in Section 10-13-1(C)1 and 10-13-1(C)2."
SECTION 2: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
SECTION 3: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 4: This Ordinance shall be in full force and effect from and after its passage,
approval, and publication in pamphlet form as provided by law.

SIXTH CONTINUATION OF EFFECTIVE DATES OF THE
MARCH 11, 2020 PROCLAMATION BY THE MAYOR
OF LOCAL DISASTER EMERGENCY
IN THE CITY OF McHENRY, ILLINOIS
On March 11, 2020, the Mayor of the City of McHenry issued a Proclamation of Local
Disaster Emergency in response to the well-publicized Coronavirus disease 2019 (COVID-19) for
a limited timeframe of seven (7) days. On March 16, 2020, April 6, 2020, May 4, 2020,
June 1, 2020,and July 20,2020,the Mayor of the City of McHenry and the City Council continued
the Proclamation with the most recent Proclamation in effect until August 17, 2020.
In accordance with the Illinois Emergency Management Act, 20 ILCS 3305/1, et seq., and
the Municipal Code, City of McHenry, Illinois, Section 6-1-14, Declaration of Local Emergency,
we, Wayne S. Jett, Mayor of the City of McHenry, and the City Council do hereby proclaim that
a local disaster emergency still exists in the City of McHenry due to ongoing Coronavirus disease
2019 (COVID-19) concerns in the City of McHenry and McHenry County. The purpose is to
activate the response and recovery aspects of any and all applicable local or interjurisdictional
disaster emergency plans,to authorize the furnishing of aid and assistance thereunder, and to bring
this to as quick of a conclusion as possible.
The City of McHenry's emergency operations plans are hereby activated for the best
interest of the residents of the City of McHenry.
This Proclamation is effective on August 17, 2020 and shall continue to
September 21, 2020.

A Resolution Authorizing a Binding Public Question on the November 3, 2020,
General Election Ballot on the Question of Appointing the City Clerk
for the City of McHenry, Illinois
WHEREAS, the City of McHenry, McHenry County, Illinois (the “City”), is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and
adoption of this Resolution constitutes an exercise of the City’s home rule powers and functions as granted in
the Constitution of the State of Illinois;
WHEREAS, the position of City Clerk of the City of McHenry is currently an elected position;
WHEREAS, among the powers and functions of a home rule municipality, the position of clerk
can be changed from elected to appointed if approved by the voters, as authorized by Article VII, Section
6 of the Illinois Constitution of 1970 that provides in relevant part that “(f)…A home rule municipality shall
have the power to provide for its officers, their manner of selection and terms of office only as approved by
referendum or as otherwise authorized by law….”;
WHEREAS, in Clarke v. Village of Arlington Heights, 57 Ill. 2d 50 (1974), the Illinois Supreme
Court upheld the ability of a home rule unit of government to convert from an elected City Clerk to an
appointed City Clerk where such action was undertaken with the approval of a city-wide referendum pursuant
to the Illinois Constitution provisions for home rule municipal units of government;
WHEREAS, pursuant to 10 ILCS 5/28-7, the City Council may, by resolution, initiate any
referendum that is required by the Illinois Constitution of 1970 with respect to the actions of the home rule
community;
WHEREAS, the City Council finds and determines that, pursuant to 10 ILCS 5/28-7, the City of
McHenry, Illinois has not initiated a referendum regarding the City Clerk position within the past twenty-
three (23) months;
WHEREAS, the City Council finds that all conditions prerequisite to the inclusion of such a
referendum question on the ballot have been satisfied by the actions authorized and directed in this resolution;
WHEREAS, the City Council finds that a referendum question regarding the appointment of the City
Clerk should appear on the November 3, 2020 ballot; and
WHEREAS, the City Council has concluded that because the Clerk’s responsibilities are primarily
administrative, that it is in the best interests of the City for the sound administration of government in an
increasingly complex and regulated environment that the Clerk position should, in the future, be appointed
rather than elected.
NOW, THEREFORE, BE IT RESOLVED by the CITY COUNCIL, of the CITY OF MCHENRY,
McHenry County, Illinois, as follows:

SECTION 1: That the following binding referendum shall be placed on the November 3, 2020,
general election ballot:
Shall the Clerk of the City of McHenry
be appointed by the Mayor, with the advice and
consent of the City Council, rather than be elected,
effective May 1, 2021?

SECTION 2: Pursuant to 10 ILCS 5/28-5, the City Clerk is hereby directed to certify this public
question to the election authorities of McHenry County in a timely manner, not less than 68 days before
the November 3, 2020 election (which date is Thursday, August 27, 2020) and to take such other actions
as shall be necessary to ensure this public question is submitted to the voters of the City of McHenry for
the November 3, 2020 election.
SECTION 3: In the event this referendum is approved by the voters of the City of McHenry,
the City Council shall take such action as is necessary to revise the City code to provide for the
appointment of the City Clerk by the Mayor, with the advice and consent of the City Council, and shall
include such other details as are necessary to establish the term of the appointed City Clerk which term
should not extend beyond the term of the appointing Mayor.
SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this Resolution
shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair,
invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect.
SECTION 5: This Resolution shall be in full force and effect upon its passage, approval and
publication in pamphlet form (which publication is hereby authorized).

RE:Discussion and direction regarding extension of the existing McHenry Downtown
TIF District
AGENDA ITEM SUMMARY:
The purpose of this item is to provide Council and Staff with an opportunity to discuss the
merits of extending the existing Downtown Tax Increment Finance District, which is set to
expire in 5 years. Given that many of the 23 years of the existing TIF (established in 2003) were
negatively impacted by the recession of 2007/2008, with property values only recently
rebounding to levels that provide a positive "tax increment", Council may want to consider an
extension to be able to take advantage of this increment to encourage continued
redevelopment of the downtown areas located within the TIF.
At the August 17th City Council Meeting, Staff will provide Council with an historical summary of
the TIF, financial impacts and future estimates, and additional information regarding the
process for requesting an extension for consideration and direction by Council.
The following and attached information has also been provided by Attorney McArdle in
preparation for the discussion:
Staff has been discussing the available options to maintain the City's economic development in
the existing Downtown TIF District. The Existing TIF District expires in 2026. From a procedural
standpoint, the City only has two options.
Option 1 is to extend the existing TIF District from its term of 23 years to 35 years, an additional
12 years. The TIF Act, attached, provides that specific legislation is required to extend the TIF
district term for specific municipalities, not to exceed 35 years, (see attached 11-74.4-3.5—
most recent TIF extension bill). There is no procedure by which the City may unilaterally extend

its term for 12 years without specific legislation tailored to it. To date 176 Villages and Cities
have successfully done so.
If the boundaries and other terms of the existing TIF remain the same and written consent from
all taxing bodies is received, we believe that, upon receiving special legislation approved by the
General Assembly, that adoption of an Ordinance confirming the extension is all that is needed
no public hearing). It may take some additional research to confirm the fact that a public
hearing is not needed, however, that is what we currently believe is the procedure.
Also for reference, below is a link to Hanover Park's agenda supplement (9/5/19) regarding its
TIF extension. Beginning on electronic page no. 57 (see also no. 176 on the attached extension
bill). Hanover Park also changed/amended the TIF area so it still had to go through the
amendment process. This is being provided as an example of a recent successful TIF extension
request.
Last year, the Village initiated the process of extending the life of TIF #3,
Village Center/TOD area, for an additional 12 years. Letters of support were
received from all taxing bodies within the TIF 3 area, and the Governor signed
the extension as well.
An amendment to the original TIF Redevelopment Plan was needed to reflect
the Village's current vision for the area. Consultant SB Friedman was hired to
conduct an eligibility analysis for extending the TIF. Through the analysis, it
was determined that the south commuter lots needed to be added to the TIF
boundary."

Option 2 is to create a new 23 year TIF District. This is a more expensive and time consuming
process that the staff is familiar with.

a-7) A municipality may adopt tax increment financing for
a redevelopment project area located in a transit facility
improvement area that also includes real property located
within an existing redevelopment project area established
prior to August 12, 2016 (the effective date of Public Act
99-792). In such case: (i) the provisions of this Division
shall apply with respect to the previously established
redevelopment project area until the municipality adopts, as
required in accordance with applicable provisions of this
Division, an ordinance dissolving the special tax allocation
fund for such redevelopment project area and terminating the
designation of such redevelopment project area as a
redevelopment project area; and (ii) after the effective date
of the ordinance described in (i), the provisions of this
Division shall apply with respect to the subsequently
established redevelopment project area located in a transit
facility improvement area.
b) The estimated dates of completion of the redevelopment
project and retirement of obligations issued to finance
redevelopment project costs (including refunding bonds under
Section 11-74.4-7) may not be later than December 31 of the
year in which the payment to the municipal treasurer as
provided in subsection (b) of Section 11-74,4-8 of this Act is
to be made with respect to ad valorem taxes levied in the 32nd
calendar year after the year in which the ordinance approving
the redevelopment project area was adopted if the ordinance was
adopted on September 9, 1999 by the Village of Downs.
The estimated dates of completion of the redevelopment
project and retirement of obligations issued to finance
redevelopment project costs (including refunding bonds under
Section 11-74.4-7) may not be later than December 31 of the
year in which the payment to the municipal treasurer as
provided in subsection (b) of Section 11-74.4-8 of this Act is
to be made with respect to ad valorem taxes levied in the 33rd
calendar year after the year in which the ordinance approving
the redevelopment project area was adopted if the ordinance was
