HomeMy WebLinkAboutOrdinances - O-79-198 - 07/16/1979 - AMEND ZONINGORDINANCE NO. 0-79-1_U AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF McHENRY, ILLINOIS BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF McHENRY, ILLINOIS, AS FOLLOWS: SECTION 1: That the Zoning Ordinance of the City of McHenry, Illinois ("Zoning Ordinance") heretofore adopted on the 12th day of March, 1962, and the Zoning Map adopted as a part thereof, and as said Zoning Ordinance and as said Zoning Map have been subsequently amended, be and they are hereby amended as follows: A. The property described in "Exhibit A" hereto attached and made a part hereof be and the same is hereby clas- sified "R-5" Condominium District as set forth in the Zoning Ordinance for the development thereon of no more than one hundred ninety-two (192) dwelling units; B. The property described in "Exhibit B" hereto attached and made a part hereof be and the same is hereby classified "R-5" Condominium District as set forth in the Zoning Ordinance for the development thereon of no more than one hundred seventy-six (176) dwelling units; and C. The property described in "Exhibit C" hereto attached and made a part hereof be and the same is hereby classified "R-1" Single Family District. SECTION 2: All maps, plats, journals and other records, including the official City map of the corporate boundaries and the zoning district map of the City of McHenry be and the same are hereby amended to reflect the zoning of the real estate as described in Section 1 hereinabove. SECTION 3: Any agricultural use of the property described on "Exhibits A" through "C" herein shall be recognized -1- as a legal nonconforming use in accordance with all the provi- sions of the Zoning Ordinance. SECTION 4: That such reclassification is made pur- suant to the affirmative recommendation of the Zoning Board of Appeals of the City of McHenry voting upon the application, following proper publication of notice, public hearing and pre -hearing conferences, all in accordance with the provisions of the Zoning Ordinance. SECTION 5: That all ordinances, or parts thereof, in conflict herewith be and the same hereby are repealed. SECTION 6: This Ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this 16a* day of C 000 , 1979.
