ORDINANCE NO. 0-79-193
AN ORDINANCE ANNEXING CERTAIN TERRITORY
TO THE CITY OF McHENRY, McHENRY
COUNTY, ILLINOIS
WHEREAS, a written petition, signed by the legal
owners of record of all land within the territory hereinafter
described, has been filed with the City Clerk of the City of
McHenry, McHenry County, Illinois, requesting that said terri-
tory be annexed to the City of McHenry; and
WHEREAS, all electors residing within the said
territory have also executed the Petition; and

WHEREAS, the said territory is not within the
corporate limits of any municipality, but is contiguous to the
City of T✓,cHenry ; and
11HEREAS, the territory is located within the McHenry
Township Fire Protection District; the City is also located
within the McHenry Township Fire Protection District and the
City does not furnish Fire Protection and no notice, therefore,
is necessary to the trustees of t},e said Fire Protection District
and the territory is not located within any Library District,

and Bull Valley Road, as it adjoins the territory,* -is not subject
to the jurisdiction of Nunda Township (being a County Road);
accordingly, no notice is necessary to the Nunda Township Town
Trustees and Highway Commissioner;
WHEREAS, the legal owner of record of said territory
and the City of McHenry have entered into a valid and binding
annexation agreement relating to such territory; and
WHEREAS, all petitions, documents, and other neces-
sary legal requirements are in full compliance with the terms
of said annexation agreement and with the statutes of the State
of Illinois, specifically Division 1 of Article 7, in Chapter 24,
ILL. REV. STATS_, and Division 15.1 of Article 11, in Chapter
24, ILL. REV. STATS.; and
WHEREAS, it is in the best interests of the City of
McHenry,, that said territory be annexed thereto,
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF MCHENRY, McHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: THAT the recitals in the preamble above
are hereby adopted as the findings of the corporate authorities
of the City of McHenry as though fully set forth herein.
SECTION 2: THAT the following described territory:
The Southeast Quarter of the Northeast Quarter
(except the West 30 acres thereof) in Section 3,
Township 44 North, Range 8, East of the Third
Principal Meridian, in McHenry County, Illinois;
Also included by operation of law in the Annexa-
tion is all that portion of Bull Valley Road
South of and adjacent to TRACT,
being indicated on an accurate map of the annexed territory,
(which is appended to and made a part of this Ordinance) is
hereby annexed to the City of McHenry, TtcHenry County, Illinois.
SECTION 3: THAT the City Clerk is hereby directed
to record with the Recorder of Deeds and to file with the
County Clerk a certified copy of this Ordinance, together with
the accurate map of the territory annexed appended to said Ordi-
nance.

SECTION 4: THAT this Ordinance shall be in full force
and effect from and after its passage{ approval, aid,..--
