ORDINANCE NO. 0-79-191
CITY. OF WHENRY
AN ORDINANCE ESTABLISHING THE ZONING DISTRICT
CLASSIFICATION OF TERRITORY NEWLY ANNEXED TO
THE CITY OF McHENRY. ILLINOIS
WHEREAS, McHENRY STATE BANK as Trustee under Trust
Agreement dated May 4, 1979, also known as Trust #1782, is the
record owner of the real estate hereinafter described; and
WHEREAS, McHENRY STATE BANK as Trustee under Trust
Agreement dated April 30, 1979, also known as Trust #1767, is
the option purchaser of the premises hereinafter described; and
WHEREAS, the owners of said real estate have hereto-
fore petitioned the Zoning Board of Appeals of the City that
the premises hereinafter described be classified as "R-3" Resi-
dence District under the provisions of the Zoning Ordinance of
the City upon the annexation of said premises to the City; and
WHEREAS, a public hearing was held with regard to
,said zoning petition, following proper notice thereof and as
a result of said hearing the City Zoning Board of Appeals has
recommended to the City Council that, upon annexation to the
City, the premises described be classified as "R-3" Residence
.District classification under the terms and provisions of the
City Zoning Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF McHENRY, ILLINOIS, as follows:
SECTION I: That the following described real estate
be and the same is hereby classified "R-3" Residence District
under the provisions of the Zoning Ordinance of the City of
McHenry, Illinois:
That part of Lot 2 of the North East quarter
of Section 2, Township 44 North, Range 8,
East of the 3rd P.M., described as follows:
Beginning at a point in the North line of
said Lot 2, 79.86 feet East of the North
West Corner thereof; thence East along said
North line, 2570.54 feet, more or less, to
the North East Corner thereof; thence South
along the East line of said Lot 2, 1312.64
feet, more or less, to the South East Corner
thereof; thence West along the South line
of said Lot 2, 1694.31 feet, more or less,
to the South East Corner of a Tract of land
conveyed to Robert Knox on March 1, 1924,
as recorded in Book 169 of Deeds, page 258;
thence North along the East line of said
Tract, 933.39 feet, to the North East Corner
thereof; thence West along the North line
of said Tract, 862.19 feet, more or less,
to a point being upon the center line of
Public Highway, that is 71.2 feet East of
the North West Corner of said Tract; thence
North 379.2 feet, more or less, along said
center line to the place of beginning, all
in McHenry County, Illinois.
SECTION II:
All maps, plats, journals and other
records, including the official City map of the corporate bound -
cries and the zoning district map of the City of McHenry be and
the same are hereby amended to reflect the annexation and the
:coning of the real estate as described in Section I hereinabove.
SECTION III: This Ordinance shall be in full force
and effect from and after its passage and approval according
-to law.
