HomeMy WebLinkAboutOrdinances - O-78-178 - 11/06/1978 - GRANT REZONING AMICI1 1 S ORDINANCE Whereas, a Petition was filed with the Zoning Board of Appeals of the City of McHenry by Anthony T. Amici and Angela D. Amici, requesting rezoning under the provisions of the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, concerning the following described premises: Parcel: A part of the Northwest Quarter of the Southwest Quarter of Section 35, Township 45 North, Range 8 East of' the State Highway, described as follows: Commencing at the West Quarter corner of Section 35; thence Easterly on the East and West Quarter Section line, 715 feet to an intersection with the East line of the State Highway (now known as Route No. 31); thence Southerly on said East line of State Highway 177.73 feet for a place of beginning; thence South 900 00" East 452.39 feet; thence South 00 01' 10" West, 111.20 feet; thence Westerly on a line parallel with said East and West Quarter Section line, 449.03 feet to the intersection with the East line of said State Highway; thence Northerly on the East line of said State Highway 110.94 feet of the place of be- ginning. All containing 1.139 acres more or less in -the City of McHenry Country, Illinois. And, Whereas, Petitioners Anthony T. Amici and Angela D. Amici are requesting classification of the above -described tract from its present "R-2" Single Family District, to "R-3" Single Family District. And Whereas, a hearing was had before the City of McHenry Zoning Board of Appeals on Friday, the 20th day of October, 1978 at which time the said Zoning Board of Appeals did take evidence and view exhibits presented thereat by the Petitioners, And Whereas, as a result of said hearing, the Zoning Board of Appeals did recommend to the City Council of the City of McHenry the granting of the Petitioners' prayers for rezoning. And Whereas, at the regular meeting of the City Council held on November 6, 1978, the Council did elect to consider the request of Petitioners, Anthony T. Amici and Angela D. Amiici,. And Whereas, as a result of such consideration, the City Council of the City of McHenry did affirm the recommendation of the Zoning Board of Appeals of the City of McHenry concerning the prayer for Rezoning as filed by Petitioners, Anthony T. Amici and Angela D. Amici. And, Whereas, the Aldermen voting to accept the recommendation of the Zoning Board of Appeals concerning the Petition of Anthony T. Amici and Angela D. Amici, did find the facts to be sufficient: to support the contentions as stated in the Petition. And, Whereas, said Aldermen did find that the premises were suited for single family development and that the five units pro- posed would be of a character so as to contribute to the nature and harmony of the area. And, Whereas, the said Aldermen did find the fact to be that the subject premises were suitable for single-family residential development by reason of the characteristics of the surrounding environs, would be in harmony and keeping with the surrounding area. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of McHenry, Illinois, as follows: The premises as hereinabove legally described shall be and is hereby reclassified as "R-3" Single Family District, and That the zoning map of the City of McHenry, be amended to reflect the aforesaid classification. PASSED on the 6th day of November, 1978. APPROVED on the 6th day of November, 1978. VOTING AYE: Bolger, Nolan, Harker, Datz, Smith, Rogers, Schooley VOTING NAY: None ABSENT: Adams ATTEST: City Clerk -2- Mayor
