HomeMy WebLinkAboutOrdinances - O-78-162 - 08/21/1978 - MCHENRY COUNTRY CLUB SPECIAL USE0-162 O_�U �l 2 AN ORDINANCE WHEREAS, your Petitioners, McHENRY COUNTRY CLUB, a not -for -profit Illinois corporation, have filed a Petition with the Zoning Board of Appeals of the City of McHenry in regard to the following described real estate: That part of the Southeast Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the, Southwest Corner of Lot 9 in McHenry Golf Course Sub- division, Fox River Addition, being a subdivision of part of the North Half of Fractional Sections 35 and 36 in Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded in the Recorder's Office of McHenry County, Illinois on October 21, 1929 in Book 8 of Plats on Page 2; thence West on the East and West Quarter Section line of said Section 35 for a distance of 225.50 feet to a point for the place of beginning; thence continuing West on said Quarter Section line for a distance of 100 feet to a point; thence South at right angles to the last described line, at the last described point, for a distance of 201.50 feet to a point; thence East parallel to the East and West Quarter Section line of said Section 35 for a distance of 100 feet to a point; thence North at right angles to the last described line, at the last described point, for a distance of 201.50 feet to the place of` beginning, in McHenry County, Illinois. requesting a Special Use permit for the use of the said property for a Country Club, including the sale of beer thereon, as provided under the provisions of the Zoning Ordinance of the City of McHenry; WHEREAS, a hearing on said Petition was held before the Zoning Board of Appeals of the City of McHenry, Illinois, in the manner and in the form as prescribed by Ordinance and Statute; WHEREAS, as a result of said hearing, the taking of - evidence, and the viewing of exhibits advanced thereat, the Zoning Board of Appeals of the City of McHenry did recommend to the City Council of the City of McHenry the granting of the requested Special Use permit, including the sale of beer thereon; WHEREAS, the City Council of the City of McHenry has considered the recommendation as submitted by the Zoning Board of Appeals of the City of McHenry; and WHEREAS, the City Council did find that the Special Use permit requested meets the standards for special uses under the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, to -wit: (a) the special use will not cause substantial injury to the value of other property in the neighborhood in which it is to be located; (b) the location and size of the special use, the nature and intensity of the operation involved in or conducted in connection with it, the size of the site in relation to it, and the location of the site with respect to streets giving access to it, shall be such that it will be in harmony with the appro- priate and orderly development of the district in which it is to be located; (c) the location, nature and height of buildings, walls and fences, and the nature and extent of the landscaping on the site shall be such that the use will not hinder or discourage the appropriate development and use of adjacent land and buildings, or will not impair the value thereof; (d) parking areas shall be of adequate size for the particular use, properly located, and suitably screened from adjoining residential uses, and the entrance and exit drives shall be laid out so as to prevent traffic hazards and nuisances. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, Illinois, as follows: 1. That a Special Use permit be and the same is hereby authorized for Country Club uses, including the sale of beer, with reference to the property hereinbefore described, and that the Superintendent of Public Works be and he is hereby directed to issue such Special Use permit with reference to said premises immediately. 2. This Ordinance shall be in full force and effect from and after its passage and approval as provided by law. PASSED this 21st day of August 1978.
