AN ORDINANCE AMENDING CERTAIN PROVISIONS
OF THE ZONING ORD114AIlCE OF THE CITY OF McHENRY
WHEREAS, the City of McHenry, as Petitioner, filed a
Petition before the Zoning Board of Appeals of the City of
McHenry, praying that the Zoning Board make recommendations
to the City Council concerning a proposed amendment of
certain provisions of the zoning ordinance of the City of
McHenry; and
tIIEREAS, a public hearing was had before the Zoning
the City of McHenry to proper Board of Appeals of
authority and proper notice therefor having been effected
through publication as by statute provided; and
1•:rIEP.EAS, the said Zoning Board of Appeals heard and
considered evidence at said hearing in regard to the alle-
gations contained in said Petition; and
Z?rH;REAS, as a result of said hearing the Zoning Board
of Appeals of the City of McHenry did make and deliver
recommendations in regard thereto to the City Council of
the City of McHenry; and
1riHEREAS, said Zoning Board of Appeals of the City of
McHenry did recommend the amendments of the zoning ordinance
of the City of McHenry hereinafter described and indicated;
and
11HEREAS, the City Council has considered such recommen-
dations.
NOW, THEREFORE, BE IT ORDADIED by the City Council of
the City of McHenry that the zoning ordinance of the City of
McHenry, as passed and approved on the 12th day of larch,
1962, and such ordinance as subsequently amended, be and
hereby is amended as follows:

SECTION 1. That Article XII, Paragraph E2 be and the
same is hereby amended so that it will read as follows:
Side Yard: Where a lot is used for any of
the purposes permitted in this District and is
located at the intersection of two or more streets,
and where an "R" District adjoins the rear of
said lot, the side yard on the side of the lot
adjacent to the street shall not be less than
ten (10) feet in width, except that the building
width of the lot shall not be reduced to less
than twenty (20) feet. In all other cases a
side yard is not required except on the side of
a lot adjoining a dwelling district, in which
case there shall be a side yard of not less than
five (5) feet.
SECTION 2. All ordinances and parts thereof, in
conflict 1•rith the terms and provisions of this ordinance be
and the same are hereby repealed to the extent of such
conflict.
SECTION 3. This ordinance shall be published in
pamphlet form by and under the authority of the corporate
authorities of the City of 14cHenry, Illinois.
SECTION 4. This ordinance shall be in full force and
effect from and after its passage and approval as by law
provided.
