HomeMy WebLinkAboutOrdinances - O-78-151 - 06/14/1978 - ANNEX NELSON PROPERTY0- r��- 15l ORDINANCE N EER. 0 -151 AN ORDLKIANCE PROVIDING FOR THE ANPMATION OF CERTA N DESCRIBED PEAL ESTATE TO THE EXISTING CORPORATE LIMITS OF THE CITY OF McHENRY, Mc=-RY COUNTY, ILLIINJIS, AND AMFMING THE ZONING ORDINANCE 0= THE CITY OF McHENRY, 11icHENRY COUi1TY , ILLINOIS TO ZONE THE PEAL ESTATE ANN= QQf record) VHEREAS, WILLIAM NELSON and CAROL NII�N are the owners of the real estate hereinafter described; and lqiERIiAS there are no electors residing on said real estate; and Z,,TRT,EAS said real estate is contiguous to the existing corporate limits of the City of McHenry, 1lHenry County, Illinois, and the owners of said real estate desire to annex said real estate and have petitioned the City Council of the City of McHenry, McHenry County, Illinois for annexation of said real estate; and U-iQZEAS the City Council for and on behalf of the City of McHenry has heretofore approved the Annexation Agreement bearing the date of, which provides in part for the annexation of said real estate to the existing corporate limits of the City of McHenry, Illinois, and for reclassification of said real estate as "B-1" Commercial Retail District, as defined by the Zoning Ordinance of the City of McHenry, Illinois; and 'r, VI-kS Notice of Public Hearing before the City of McHenry Zoning Board of Appeals was published in. the McHenry Plaindealer, a newspaper of general circulation on the City of .1cHenry, within the time provided by law; and [IRMAS the City of McHenry Zoning Board of Appeals has held a public hearing on the re -zoning of the property herein described to the "B-l" Commercial Retail District and has filed its report with the City Council recc mending that the zoning reclassification be approved; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF M-c ENRY, Mc EERY COUNTY, ILLINOIS , AS FOLLOWS: SECTION I: The following described real estate be, and the same is hereby annexed to and made a part of the corporate limits of the City of McHenry, McHenry County, Illinois including all adjoining roads or high -rays as required by law: That part of the Southwest Quarter of Section 2, Township 44 North, Range 8 East of the Third Principal Meridian described as follows: Beginning at the Northt•7est corner of said Southwest Quarter; thence Easterly along the North line of said Southwest Quarter 772.4 feet to a point on the Westerly right of way line of U.S. Route 12; thence Southwesterly along said right of way line 279.9 feet; thence Westerly 722.35 feet to a point on the West line of aforesaid Southwest Quarter, said point being 275.77 feet to the place of beginning, (excepting and reserving therefrom that part of the above described property dedicated for high, -ay purposes on November 30, 1973 as Document No. 607445 described as follows: Beginning at the Northwest corner of the Southwest Quarter of said Section 2; thence Easterly on the North line of said Southwest Quarter, 772.4 feet to a point on the 1,Lesterly right of -..:.ay line of a public highway mown as United States No. 12; thence Southerly on said Westerly right of way line, 51.12 feet; thence Westerly in a straight line to a point on the Vest line of said Southwest Quarter, this point being Southerly -2- of and 100.0 feet distant from the Northwest corner of said Southwest Quarter; thence Northerly on the West line of said Southwest Quarter, 100. 0 feet to said point of begirn ng) , in McHenry County, Illinois. The subject property is located approximately at the Southwest corner of State Route 31 and Bull Valley Road in Nunda Township, McHenry County, Illinois; said property consists of approximately 3.4073 acres. SECTION II: The City Clerk is hereby directed to procure an accurate map of the real estate above described and annexed, and when satisfied as to the accuracy of said map, record a certified copy of this Ordinance and said accurate map attached thereto as Exhibit "A" in the Office of the Recorder of Deeds, McHenry County, Illinois. Following the recording of this Ordinance and the map of the above described and annexed real estate, a copy thereof shall be filed in the Office of the Clerk of McHenry County, Illinois. SECTION III: The real estate described and annexed in Section I is hereby classified "B-1" Commercial Retail District, as defined in the Zoning Ordinance of the City of McHenry, McHenry County, Illinois. SECTION IV: The report of the City of McHenry Zoning Board of Appeals, which includes the express finding that said property is hereby reclassified "B-1" Commercial Retail District be, and the sane are hereby approved. SECTION V: All maps, plats, journals and other records including the official map of the corporate boundaries and the zoning district map of the City of McHenry be, and the same are hereby amended to reflect the annexation and the zoning of the above described real estate. -3- SECTION VI: This Ordinance shall be known as Ordinance No. 0-151 and shall be in full force and effect from and after its passage and approval as required by law.
