HomeMy WebLinkAboutOrdinances - O-78-147 - 05/15/1978 - AMEND ZONING AND GRANT VARIATION GERASCH PROPERTY0-147 ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF MC HENRY, ILLINOIS WHEREAS, an application has been made to amend the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, to effect a variation of the Zoning Ordinance of the City of McHenry to permit the construction of a residence with office facilities for the conduct of Petitioner, Barbara Gerasch's, business of a telephone answering service on the premises only for such time as she shall own and operate said business while occuping the premises as her residence or for two years after her demise in the event that Petitioner is operating said business at the time of her demise, as to the following described premises: Lots 4 and 5 in Block 4 of the Original Plat of McHenry, on the West side of Fox River, being a Subdivision of part of the Southeast Quarter of Section 26, Township 45 North, Range 8 East of the Third Principal -Meridian, according to the Plat thereof recorded July 6, 1840 in Book B of Deeds, page 160, in McHenry County, Illinois. AND, WHEREAS, the provisions of the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, have been found to have been complied with by Petitioners; i AND, WHEREAS, a public hearing has been duly held by the Zoning Board of Appeals of the City of McHenry and, as a result of such hearing, the Zoning Board of Appeals has recommended to the City Council to approve the Petition of Barbara Gerasch for the granting of the variation as to the concerned prerises allowing its use for the construction of a residence with office facilities for the conduct of a telephone answering service on the premises only for such time as Petitioner would own and operate said business while occupying said premises as her residence, or for two years after her demise should she still be operating and occupying said business at that time. service on the permises only for such time as Petitioner would own and operate said business while occupying said premises as her residence, or for two years after her de- mise should she still be occupying said business at that time, and that the appropriate permit, or permits, for same shall issue for such use when properly requested. The passage of this Ordinance as moved by seconded by Harker Mayor declared the motion passed. Nolan and upon a vote being taken, the Passed and approved this 15th day of May, 197S.
