HomeMy WebLinkAboutOrdinances - O-78-141 - 04/17/1978 - KNAPIK/CAREY APPLIANCE REZONING0 - r1f-1 Y/ 0--141 ORDINANCE WHEREAS, a Petition was filed with the Zoning Board of Appeals of the City of McHenry by Walter Knapik and Jeanette Knapik, his wife, and Carey Appliance, Inc. , an Illinois corporation, requesting an Amendment under the provisions of the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, to reclassify from the existing "R-2" Single - Family District to "B-1" Commercial Retail District, the following described premises: PARCEL 1: The South 128. 15 feet as measured on the East line thereof of that part of the Southwest Quarter of the South- west Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian, bounded and described as follows, to -wit: Commencing at the Northwest corner of the Southwest Quarter of the Southwest Quarter of said Section 35; thence Easterly along the Quarter Quarter Section line a distance of 666. 18 feet to the Westerly line of Illinois State Highway running in a Northerly and Southerly direction through said Southwest Quarter of the Southwest Quarter of said Section 35; thence Southerly along said Westerly line of Illinois State High- way a distance of 646. 51 feet; thence Westerly and parallel to said Quarter Quarter Section line a distance of 681. 4 feet to the Westerly line of said Section 35; thence Northerly along said Section line a distance of 646. 6 feet to the place of beginning, in McHenry County, Illinois. PARCEL 2: The North 128. 71 feet of the South 256. 86 feet as measured on the East line thereof of that part of the Southwest Quarter of the Southwest Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian, bounded and described as follows, to -wit: Commencing at the Northwest corner of the Southwest Quarter of the Southwest Quarter of said Section 35; thence Easterly along the Quarter Quarter Section line a distance of 666. 18 feet to the Westerly line of Illinois State Highway running in a Northerly and Southerly direction through said Southwest Quarter of the Southwest Quarter of said Section 35; thence Southerly along said Westerly line of Illinois State Highway a distance of 646. 51 feet; thence Westerly and parallel to said Quarter Quarter Section line a distance of 681. 4 feet to the Westerly line of said Section 35; thence Northerly along said Section line a distance of 646. 6 feet to the place of beginninu in McHenry C'nvinty T11innia AND, WHEREAS, as a result of taking such evidence and viewing such exhibits, the Zoning Board of Appeals did recommend to the City Council of the City of McHenry that the zoning reclassification and Amendment of the Zoning Ordinance of the City of McHenry be granted to the Petitioners by the City Council of said City of McHenry, as being in compliance with all of the required facts and findings pertaining to such reclassification as set forth in the Zoning Ordinance of the City of McHenry, and such Ordinance as amended,+ AND, WHEREAS, the City Council of the City of McHenry is in agreement with the findings of the Zoning Board of Appeals as based on the evidence and exhibits presented by the Petitioners. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of McHenry, Illinois, that the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, is hereby amended to effect the reclassification of the premises described hereinabove to "B- 1" Commercial Retail District, and that the Zoning Map of the City of McHenry reflect such reclassification. BE IT FURTHER ORDAINED, that the officer, or officers, of this City enforcing such Zoning Ordinance shall issue, or cause to be issued, such permit, or permits, as shall be required to effect such "B-1" Commercial Retail District usage.
