HomeMy WebLinkAboutOrdinances - O-78-133 - 01/30/1978 - GRANTING PUD PHEASANT VALLEY SUB0-133 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF McHENRY, ILLINOIS O-74'-13.3 BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF McHENRY, ILLINOIS, AS FOLLOWS: SECTION l: That the Zoning Ordinance of the City of McHenry, Illinois, heretofore adopted on the 12th day of March, 1962, and the Zoning Map adopted as a part thereof, and as said Zoning Ordinance and as said Zoning Map have been subsequently amended, be and they are hreby amended as follows: A. That the property described in "Exhibit A" hereto attached and made a part hereof be and the same is hereby classified as a Planned Unit Development under the provisions of Article XV entitled, "Special Uses", paragraph E, entitled "Planned Unit Development". SECTION 2: That such special use is authorized upon the finding that: A. The special use will not cause substantial injury to the value of other property in the neighborhood in which it is located. B. The location and size of the special use, nature and intensity of the operation involved in or conducted in connection with it, the size of the site in relation to it, and the location of the site with respect to streets giving access to it, shall be such that it will be in harmony with the appropriate and ordinary development of the district in which it is located. C. The location, nature and height of buildings, walls and fences and the nature and extent of the landscaping on the site shall be such that the use will not k screened from adjoining residential uses, and the entrance and exit drives shall be laid out so as to prevent traffic hazards and nuisances. E. The uses permitted by any exceptions are necessary and desirable and appropriate to the purpose of the development. F. The uses permitted in the development are not of such nature or so located as to exercise a detrimental influence or effect upon the surrounding neighborhood. G. That no industrial areas will be established in the Planned Unit Development. H. That all minimum requirements pertaining to commercial, residential, institutional or other uses established in the Planned Unit Development will be subject to the requirements for each individual classification as established elsewhere in this Ordinance, except as may be specifically varied hereinafter. SECTION 3: That the uses of the areas delineated shall be, and they are hereby established as follows: Commercial, Single Family Residential, and Public Park; and that these use areas be, and are hereby established as shown upon the Use Area Map hereto attached and made a part hereof as "Exhibit B". SECTION 4: That said Planned Unit Development is authorized as a special use upon the following conditions: A. That in the Single Family Residential District variation in minimum lot area requirements will be permitted as follows: 50% will have a 20% reduction, 20% will have a 10% reduction and 30% will have no reduction. SECTION 7: That this Ordinance shall be in effect from and after its passage and approval, according to law. Passed and approved this day of Jannary , 1978.
