AN ORDINANCE AMENDING THE CITY
i OF McHENRY ZONING ORDINANCE
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
McHENRY, ILLINOIS as follows:
SECTION 1: That the Zoning Ordinance of the City of McHenry, Illinois.
as passed, approved, and as subsequently amended and now in effect and the Zoning
Map for the City of McHenry. Illinois adopted as a part of the Zoning Ordinance
are hereby amended to reclassify from "R-3A" SINGLE FAMILY DISTRICT TO "B-
1" COMMERCIAL RETAIL DISTRICT the following described property, to -wit:
Lots 10, 11, 12, 13, 14, 15, 16 and 17 in Block 2 in Lakeland Park Unit No
3, a Subdivision of part of the East Half of the East Half of Section 28, Town-
ship 45 North, Range 8 East of the Third Principal Meridian, according to
the Plat thereof recorded September 8, 1953 as Document No. 269384, in
Book 11 of Plats, page 90, in McHenry County, Illinois.
SECTION 2: That such Amendment to the Zoning Ordinance is made pursuant
to affirmative findings and affirmative recommendation of the Zoning Board of
Appeals, following proper application therefore, publication of Notice thereof, and
public hearing thereon, all in accordance with the provisions of the Zoning Ordinance.
SECTION 3: That all ordinances or parts thereof in conflict herewith be
and the same are hereby repealed.
SECTION 4: That this ordinance shall be in effect from and after its passage
and approval according to law.

WATER MAIN EXTENSION AGREEMENT
THIS AGREEMENT made this U---- day of Deember, 1977, betweeq:,
the City of c' Henry, a Municipal Corporation of the State` of Illinois, hereafter
referred to as the "City", and the undersigned owners of lots abutting on Illinois
Route 120 in Block 2 in Lakeland Park Unit No. 3, a Subdivision of part of the East
Half of the East Half of Section 28, Township 45 North, Range 8 East of the Third
Principal Meridian, according to the Plat thereof recorded September 8, 1953 as
Document No. 269384 in Book 11 of Plats, page 90, in McHenry County, Illinois, as
hereafter set forth after their names, to -wit:
Patricia A. Burke & Betty J. Sawey
McLake Co., Inc., an Illinois Corporation
Phillip J. Pawl, as Trustee under Declaration
of Trust dated January 3, 1974
Jacob J. Schadt & Mary Ann Schadt
Charles T. Hill and Edith S. Hill and
Phillip Pawl as Trustee under Declaration
of Trust dated January 3, 1974
Lot 10
Lot 11
Lot 12, 13 and 14
Lot 15 and 16
Lot 17
WHEREAS it is of mutual advantage to the parties to have the City
install an 8 inch diameter or greater water main and fire hydrant to serve the
aforesaid lots and whereas said lots already have available to them at the rear of
said lots a 4 inch water main owned by the Lakeland Park Water Company.
NOW, THEREFORE, it is agreed as follows:
1. That the City shall, on or before July 1, 1978, install an 8 inch or
greater water main to service said lots and fire hydrant at the East end of the block.
2. The lot owners shall pay to the City the sum of $560.00 per lot for
their proportionate share of the project. Payments shall be made on or before July
1, 1978. If payments are not made by July 1, 1978, then any unpaid balance due
thereafter shall bear interest at the rate of 714% per annum until paid in full. The
City shall have the right to place a lien upon any lot for which there is an unpaid
balance due after July 1, 1978. The lien shall be effective against any lot upon

installation do not include tap in (connection) fees or Capital Development Fund
Fees and that Captial Development Fund Fees will not be charged upon the
connection of existing residences.
4. The City agrees to defend the lot owners or pay the cost of their
defense should the Lakeland Park Water Company take any legal action against the

owners as a result of the installation provided for herein or as a result of the owners
discontinuing water service from the Lakeland Park Water Company and the City
further agrees to indemnify the lot owners for any loss to them by reason thereof.
5. If Lakeland Park Water Company takes any action against any of
the parties which delays the installation, then the time for installation and the time
for payment shall be extended for a period of time equal to such delay. Should any
Court prohibit the installation, then this contract shall become null and void.
