HomeMy WebLinkAboutOrdinances - O-77-116 - 08/15/1977 - AMEND ZONING LAWSON RIVERSIDE DRORDINANCE N0.0-116 AMENDING THE ZONING ORDINANCE AND ZONING MAP OF THE CITY OF McHENRY, ILLINOIS WHEREAS, a Petition was filed by THOMAS LAWSON and RUTH J. LAWSON, his wife, with the Zoning Board of Appeals of the City of McHenry, concerning the following described premises: Lot 2 in Block 5 in the Original Plat of West McHenry, according to the Plat thereof recorded June 14, 1859, in Book 24 of Deeds, page 22, all in the Southwest Quarter of Section 26, Township 45 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois. AND WHEREAS, after proper legal notice being served by publication and through the United States Mails on all interested parties, a public hearing was had before the said Zoning Board of Appeals of the City of McHenry on the 8th day of July, 1977, AND WHEREAS, after the hearing of testimony and viewing of exhibits on behalf of said Petitioners at such hearing, the Zoning Board of Appeals did find the following facts: 1. That the request of the Petitioners to reclassify the subject premises from "R-311 Single -Family District" to "R-4" Multi -Family District should be amended to request a Variation of the IIR-311 classification which would allow the construction of a duplex residential structure on the premises. 2. That the subject premises, as varied in use under the amended Petition, would be in harmony and keeping with developments in the surrounding area, and would retain the single family zoning characteristics of the area. 3. That the premises under its proposed use, would not have a detrimental effect on property values or lifestyles in the area. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, Illinois, that the premises as hereinabove -described may be utilized for the construction of a duplex residential structure under a LOOZE & KINNE Arrf+- NEYS us• — . srnerr M ( ILLINOIS I -1- Variation of the Zoning Ordinance, and that the subject property retain its "R-3" Single Family District classification. BE IT FURTHER ORDAINED that the proper officer, or officers, of this City be and hereby are authorized and directed to issue such permit, or permits, as shall be necessary to effectuate this Ordinance, and BE IT FURTHER ORDAINED that the Official Zoning Map of the City of McHenry, Illinois, be altered to reflect this amendment. The passage of this Ordinance as moved by Alderman Bolger , seconded by Alderman DAtz J. and upon roll call vote being taken, the Mayor declared the Ordinance passed.
