HomeMy WebLinkAboutOrdinances - O-77-100 - 04/04/1977 - VACATE STREET VENICE PARK ADDTNORDINANCE NO. 0-100 O-77/O0 AN ORDINANCE WHEREAS, the corporate authorities are authorized by the terms and provisions of Section 11-91-1 et. seq. of the Illinois Municipal Code to vacate any part of any public street; and, Whereas, it is the judgment and determination of the corporate authorities of the City of McHenry that the public interest will be subserved by vacating the street, lane, or alley hereinafter described in Section 1 of this ordinance. NOW, THEREFORE, be it ordained by the Mayor and City Council of the City of McHenry, McHenry County, Illinois, as follows: Section 1: That part of the street, lane, or alley identified asTHe Private Lane Number 1 on the Plat of Venice Park Addition to McHenry, Unit Number 1 hereinafter described, be and the same is hereby vacated to -wit: The East 30 feet of Lot 1 (as measured along the south line thereof) in Block 3 of the Plat of Venice Park Addition to McHenry, Unit No. 1, a subdivision of part of the Southeast Fractional Quarter of Section 26 and part of the Northeast Fractional Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded February 25, 1941 as Document Number 152920, in Book 7 of Plats, page 68, in McHenry County, Illinois; ALSO That part of Private Lane No. 1, shown in the said Plat of Venice Park Addition to McHenry, Unit No. 1, lying East of the Easterly line of Lot 5 in Block 2 of said Addition, in the City of McHenry, McHenry County, Illinois. provided that the City retains the right to maintain, operate, repair and replace sanitary and storm sewer mains, water mains or any other facility or equipment for the maintenance or operation of any utility now located in the street, or portion thereof, vacated by this ordinance. Section 2: All ordinances, or parts thereof, in conflict herewith are hereby repealed. Section A certified copy of this ordinance shall be recorded with the McHenry County Recorder of Deeds. Section 4: That this ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this 4th day of APR I L , 1977.
